HOUSE BILL NO. 511

HIGHER ED/BD REGENTS:  (Constitutional Amendment) Provides relative to Board of
Regents authority to coordinate programs
1	A JOINT RESOLUTION
2Proposing to add Article VIII, Section 5(D)(6) of the Constitution of Louisiana, to provide
3 relative to the authority of the Board of Regents; to authorize the Board of Regents
4 to coordinate programs to improve efficiency; to provide for submission of the
5 proposed amendment to the electors; and to provide for related matters.
6 Section 1.  Be it resolved by the Legislature of Louisiana, two-thirds of the members
7elected to each house concurring, that there shall be submitted to the electors of the state of
8Louisiana, for their approval or rejection in the manner provided by law, a proposal to add
9Article VIII, Section 5(D)(6) of the Constitution of Louisiana, to read as follows:
10 §5.  Board of Regents
11	Section 5.

13	(D)  Powers.  The Board of Regents shall meet with the State Board of
14 Elementary and Secondary Education at least twice a year to coordinate programs
15 of public elementary, secondary, vocational-technical, career, and higher education. 
16 The Board of Regents shall have the following powers, duties, and responsibilities
17 relating to public institutions of postsecondary education:

19	(6)  To plan, manage, and coordinate particular postsecondary education
20 programs and functions, which may include consolidation or alteration of programs

1 and functions among institutions or systems, as the board determines necessary to
2 improve the efficiency of institutions or systems or both in providing educational
3 services in the state.
4 Section 2.  Be it further resolved that this proposed amendment shall be submitted
5to the electors of the state of Louisiana at the statewide election to be held on November 8,
62016.
7 Section 3.  Be it further resolved that on the official ballot to be used at the election,
8there shall be printed a proposition, upon which the electors of the state shall be permitted
9to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as
10follows:
11	Do you support an amendment to authorize the Board of Regents to manage
12	higher education programs and functions as it determines necessary to
13	improve efficiency? (Adds Article VIII, Section 5(D)(6))

Abstract:  Authorizes the Bd. of Regents to manage higher education programs and
functions as it determines necessary to improve efficiency.
Present constitution creates the Bd. of Regents to plan, coordinate, and have budgetary
responsibility for all public postsecondary education.  Grants the board specific powers and
provides that powers not granted to the Bd. of Regents are reserved to the individual system
management boards.
Proposed constitutional amendment authorizes the Bd. of Regents to plan, manage, and
coordinate particular postsecondary education programs and functions as the board
determines necessary to improve the efficiency of institutions or systems or both.
Provides for submission of the proposed amendment to the voters at the statewide election
to be held Nov. 8, 2016.
