HOUSE BILL NO. 513

DISTRICTS/SPECIAL:  Provides relative to the audit of certain contracts with the Algiers
Development District
1	AN ACT
2To amend and reenact R.S. 33:2740.27(K), relative to Orleans Parish; to provide relative to
3 the Algiers Development District; to provide relative to the powers and duties of the
4 district; to authorize the legislative auditor to audit contracts the district enters for
5 certain purposes; to provide limitations; and to provide for related matters.
6	Notice of intention to introduce this Act has been published
7	as provided by Article III, Section 13 of the Constitution of
8	Louisiana.
9Be it enacted by the Legislature of Louisiana:
10 Section 1.  R.S. 33:2740.27(K) is hereby amended and reenacted to read as follows:
11 ยง2740.27.  The Algiers Development District; creation, composition, and powers;
12	levy of ad valorem taxes and issuance of bonds
13	*          *          *
14	K.(1)  The district may enter into contracts with any private entity for the
15 purpose of development within the boundaries of the district.  No such private entity
16 shall be considered a public or quasi public entity or a public body as a result of
17 entering into a contract with the district.  No such private entity shall be considered
18 a public or quasi public entity or a public body as a result of receiving or expending
19 funds of or on behalf of the district.  Such contracts shall be subject to audit by the

1 legislative auditor who may exercise the power and authority granted to him by R.S.
2 24:513 with respect to such contracts.  However, no private entity shall be
3 considered a public or quasi public entity or a public body as a result of entering into
4 a contract with the district or as a result of receiving or expending funds of or on
5 behalf of the district.
6	(2)  No provision of this Subsection shall be construed to apply to any
7 contract entered into by the district with an investor owned utility that is regulated
8 by the Louisiana Public Service Commission or by the governing authority of the
9 city of New Orleans.

Abstract:  Authorizes the legislative auditor to audit certain contracts that private entities
have with the Algiers Development District for the purpose of development within
the district.
Present law creates the Algiers Development District as a special taxing district comprised
of all territory within the 15th ward of Orleans Parish.  Provides that for federal purposes of
military base realignment, the district shall be considered a local redevelopment authority.
Provides that the district shall be governed by a seven-member board of commissioners.
Present law provides for the powers and duties of the district including the power to acquire,
to lease, to insure, and to sell real property within its boundaries.  Additionally authorizes
the district, with respect to real or immovable property owned by it and that either was
formerly owned by the U.S. Dept. of the Navy and known as Federal City or is immediately
contiguous thereto, to lease, insure, mortgage or hypothecate, donate, or sell the property or
otherwise contract with respect to the management and development of the property in order
to fulfill its mission as a redevelopment authority.
Proposed law retains present law.
Present law authorizes the district to enter into contracts with any private entity for the
purpose of development within the boundaries of the district.  Provides that no such private
entity shall be considered a public or quasi public entity or a public body as a result of
entering into a contract with the district or receiving or expending funds of or on behalf of
the district.  Proposed law retains present law and authorizes the legislative auditor to audit
the contracts that private entities have with the district for the purpose of development within
the boundaries of the district.  Provides that proposed law shall not be construed to apply to
any contract entered into by the district with an investor owned utility that is regulated by
the La. Public Service Commission or by the governing authority of the city of New Orleans.
