HOUSE BILL NO. 569

AGRICULTURE:  Provides relative to designated authorities for federal and state
cooperation with provisions of the Federal Meat Inspection Act and Federal Poultry
Products Inspection Act
1	AN ACT
2To amend and reenact R.S. 3:4222(A) and (B) and to repeal R.S. 3:4222(D), relative to
3 designated authorities for federal and state cooperation; to clarify certain provisions 
4 of the Federal Meat Inspection Act and Federal Products Inspection Act; and to
5 provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 3:4222(A) and (B) are hereby amended and reenacted to read as
8follows:
9 ยง4222.  Federal and state cooperation; designated authority
10	A.  The commissioner is hereby designated as the state agency which shall
11 be responsible for cooperating with the secretary of agriculture of the United States
12 under the provisions of Sections 114 and 114a of the Federal Meat Inspection Act
13 and Section 467 of the Federal Poultry Products Inspection Act and such agency is
14 directed to cooperate with the secretary of agriculture of the United States in
15 developing and administering the meat inspection program of this state under this
16 Chapter to assure that not later than November 15, 1970 its requirements will be at
17 least equal to those developing and administering the program of this state under the
18 provisions of this Chapter in such a manner as will effectuate the purposes of this
19 Chapter and said federal acts.  However, no provision of this Chapter shall be

1 understood or construed as changing or repealing any present constitutional
2 provision or statutory law of the state with respect to the powers, duties and
3 responsibilities of the Louisiana State Department of Health or with respect to the
4 Sanitary Code or the State Food, Drugs and Cosmetic Act except to the extent and
5 only to the extent of direct conflict with the provisions herein contained and rules
6 and regulations adopted pursuant thereto.  Where practical the Louisiana Department
7 of Agriculture shall enter into a contractual agreement with the Louisiana
8 Department of Health for services presently being rendered by the Louisiana State
9 Department of Health and all related services under the provisions of various
10 applicable laws, to the extent necessary to assure compliance with the provisions and
11 purposes of this Chapter.
12	B.  In such cooperative efforts, the commission commissioner of agriculture
13 is authorized to accept from said secretary advisory assistance in planning and
14 otherwise developing the state program, technical and laboratory assistance and
15 training including necessary curricular and instructional materials and equipment,
16 and financial and other aid for administration of such a program.  The commissioner
17 is further authorized to spend public funds of this state appropriated for
18 administration of this Chapter to pay fifty per centum of the estimated total cost of
19 the cooperative program.

21 Section 2. R.S. 3:4222(D) is hereby repealed in its entirety.

Rouge Parish Health Unit from present law due to the lack of a city or parish meat
inspection program.
Present law references Sections 114 and 114a of the Federal Meat Inspection Act and
Section 467 of the Federal Poultry Products Inspection Act.

Proposed law removes these references as they have been repealed.
Present law specifies that the commission, in a cooperative effort with the secretary of
agriculture of the U.S., is authorized to accept assistance from the secretary in planning or
developing a state meat inspection program.
Proposed law specifies that the commissioner of agriculture instead of the commission, has
the authority to enter into a cooperative effort with the secretary.
Present law provides for the East Baton Rouge Parish Health Unit's meat inspection program
and its designation as a part of the state agency insofar as said meat inspection program is
concerned.
Proposed law removes the East Baton Rouge Parish Health Unit from present law due to the
lack of a city or parish meat inspection program.
