ENROLLED 2016 Regular Session HOUSE BILL NO. 569 BY REPRESENTATIVE SCHEXNAYDER 1 AN ACT 2 To amend and reenact R.S. 3:4222(A) and (B) and to repeal R.S. 3:4222(D), relative to 3 designated authorities for federal and state cooperation; to clarify certain provisions 4 of the Federal Meat Inspection Act and Federal Poultry Products Inspection Act; and 5 to provide for related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 3:4222(A) and (B) are hereby amended and reenacted to read as 8 follows: 9 ยง4222. Federal and state cooperation; designated authority 10 A. The commissioner is hereby designated as the state agency which shall 11 be responsible for cooperating with the secretary of agriculture of the United States 12 under the provisions of Sections 114 and 114a of the Federal Meat Inspection Act 13 and Section 467 of the Federal Poultry Products Inspection Act and such agency is 14 directed to cooperate with the secretary of agriculture of the United States in 15 developing and administering the meat inspection program of this state under this 16 Chapter to assure that not later than November 15, 1970 its requirements will be are 17 at least equal to those imposed pursuant to the Federal Meat Inspection Act and in 18 developing and administering the program of this state under the provisions of this 19 Chapter in such a manner as will effectuate the purposes of this Chapter and said the 20 federal acts. However, no provision of this Chapter shall be understood or construed 21 as changing or repealing any present constitutional provision or statutory law of the 22 state with respect to the powers, duties and responsibilities of the Louisiana State 23 Department of Health or with respect to the Sanitary Code or the State Food, Drugs Page 1 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HB NO. 569 ENROLLED 1 and Cosmetic Act except to the extent and only to the extent of direct conflict with 2 the provisions herein contained and rules and regulations adopted pursuant thereto. 3 Where practical the Louisiana Department of Agriculture shall enter into a 4 contractual agreement with the Louisiana Department of Health for services 5 presently being rendered by the Louisiana State Department of Health and all related 6 services under the provisions of various applicable laws, to the extent necessary to 7 assure compliance with the provisions and purposes of this Chapter. 8 B. In such cooperative efforts, the commission commissioner is authorized 9 to accept from said the secretary advisory assistance in planning and otherwise 10 developing the state program, technical and laboratory assistance and training 11 including necessary curricular and instructional materials and equipment, and 12 financial and other aid for administration of such a program. The commissioner is 13 further authorized to spend public funds of this state appropriated for administration 14 of this Chapter to pay fifty per centum of the estimated total cost of the cooperative 15 program. 16 * * * 17 Section 2. R.S. 3:4222(D) is hereby repealed in its entirety.
