BY REPRESENTATIVES SMITH, ADAMS, AND STEVE CARTER
MTR VEHICLE/LICEN PLATES:  Provides relative to the special college and university
license plates
1	AN ACT
2To amend and reenact R.S. 47:463.31(A), (B), (C), and (E), relative to the issuance of
3 special college and university license plates; to increase the fee for such plates; to
4 authorize personalized plates; to provide relative to charitable donations associated
5 with such plates; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 47:463.31(A), (B), (C), and (E) are hereby amended and reenacted
8to read as follows:
9 ยง463.31.  Special college and university license plates
10	A.  Upon the request of any public college or university in Louisiana or any
11 other institution pursuant to Subsection H of this Section, the secretary of the
12 Department of Public Safety and Corrections shall establish special prestige motor
13 vehicle license plates for such institution.  The license plates shall be restricted to
14 passenger cars, pick-up trucks, vans, and recreational vehicles.  The license plate
15 shall be of a color and design selected by the institution requesting issuance of the
16 prestige plate and shall bear the name of the institution.  No institution shall request
17 any change to the design or color of the license plates within a five-year period from
18 the date of acceptance of a specific color and design.  An applicant may request a
19 personalized prestige plate under the provisions of this Section and such personalized
20 plate shall be issued at no additional cost to the applicant.

1	B.(1)  The prestige license plates shall be issued, upon application, to any
2 citizen of Louisiana in the same manner as any other motor vehicle license plate. 
3 The applicant shall designate his institutional preference.
4	(2)  Application for college or university special prestige license plate
5 constitutes prior written consent and instruction by the applicant to the department
6 to provide his name, address, and birth date to the university designated by the
7 applicant.  The secretary shall ensure that the application for the plate includes a
8 statement granting such consent.
9	C.  An annual royalty fee of twenty-six fifty-one dollars for the use of the
10 institution's design by the department shall be paid to the institution for each license
11 plate issued as provided in this Section.

13	E.  The department shall collect the annual royalty fee required by Subsection
14 C of this Section for each license plate.  The department shall retain one dollar from
15 each annual royalty fee to offset administrative costs.  The remainder of the royalty
16 fee shall be forwarded to the specific institution for which such license plate is
17 designated.  The amount forwarded to the designated institution shall be deemed to
18 be a charitable donation to that institution by the applicant.

Abstract:  Increases the fee for a college or university special prestige license plate and
provides for certain other conditions.
Present law provides that upon request by any public college or university in Louisiana the
commissioner of motor vehicles is required to establish a special prestige license plate for
that college or university.  Provides relative to the design and color of the plates.  Provides
for a $26 annual fee for such plate with $25 of the fee going to the college or university to
be used solely for academic or financial need-based scholarships to the institution.
Proposed law increases the fee from $26 to $51 and specifies that an applicant may request
a personalized plate to be issued at no additional cost to the applicant.

Proposed law specifies that the amount from each plate that goes to the college or university
is deemed to be a charitable donation to that institution by the applicant and specifies that
the application for the plate constitutes prior written consent and instruction by the applicant
to the department to provide his name, address, and birth date to the university designated
by the applicant.  Requires the secretary to ensure that the application for the plate includes
a statement granting such consent.
