MTR VEHICLE/LICEN PLATES:  Provides relative to the special college and university
license plates
1	AN ACT
2To amend and reenact R.S. 47:463.31(B), (C), (E), (F), (G)(1), and (H), relative to the
3 issuance of special college and university license plates; to increase the fee for such
4 plates; to provide relative to charitable donations associated with such plates; and to
5 provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 47:463.31(B), (C), (E), (F), (G)(1), and (H) are hereby amended and
8reenacted to read as follows:
9 ยง463.31.  Special college and university license plates

11	B.(1)  The prestige license plates shall be issued, upon application, to any
12 citizen of Louisiana in the same manner as any other motor vehicle license plate. 
13 The applicant shall designate his institutional preference.
14	(2)  Application for college or university special prestige license plate
15 constitutes prior written consent and instruction by the applicant to the department
16 to provide his name, address, and birth date to the university designated by the
17 applicant.  The secretary shall ensure that the application for the plate includes a
18 statement granting such consent.

1	C.  An annual royalty fee of twenty-six dollars for the use of the institution's
2 design by the department fifty-one dollars shall be paid to the institution for each
3 license plate issued as provided in this Section.

5	E.  The department shall collect the annual royalty fee required by Subsection
6 C of this Section for each license plate.  The department shall retain one dollar from
7 each annual royalty fee to offset administrative costs.  The remainder of the royalty
8 fee shall be forwarded to the specific institution for which such license plate is
9 designated.  The amount forwarded to the designated institution shall be deemed to
10 be a charitable donation to that institution by the applicant.
11	F.  The secretary shall establish such rules and regulations as are necessary
12 to implement the provisions of this Section, including but not limited to rules and
13 regulations governing the collection and disbursement of royalty fees, the transfer
14 and disposition of such license plates, the colors available, and the design criteria.
15	G.(1)  The monies received from the royalty fees by each respective
16 institution shall be used solely for academic or financial need-based scholarships for
17 that participating institution.

19	H.  Upon the signing of a contract authorizing the use of the logo of any
20 regionally accredited independent college or university, the secretary of the
21 Department of Public Safety and Corrections shall establish prestige motor vehicle
22 license plates for said college or university in accordance with the provisions of this
23 Section.  This contract shall include an agreement on the part of each institution to
24 use the royalty fees as provided in Subsection G of this Section.

Abstract:  Increases the fee for a college or university special prestige license plate and
provides for certain other conditions.
Present law provides that upon request by any public college or university in Louisiana the
commissioner of motor vehicles is required to establish a special prestige license plate for
that college or university.  Provides relative to the design and color of the plates.
Proposed law retains present law.
Present law provides that an annual royalty fee of $26 for the use of the institution's design
by the department is to be paid to the institution for each license plate issued as provided in
present law.
Proposed law increases the fee from $26 to $51.
Proposed law removes language stating that the fee is for the use of the institution's design
and removes language providing that such fee is a royalty fee.
Proposed law specifies that the amount from each plate that goes to the college or university
is deemed to be a charitable donation to that institution by the applicant and specifies that
the application for the plate constitutes prior written consent and instruction by the applicant
to the department to provide his name, address, and birth date to the university designated
by the applicant.  Requires the secretary to ensure that the application for the plate includes
a statement granting such consent.

Summary of Amendments Adopted by House
The Committee Amendments Proposed by House Committee on Transportation,
Highways and Public Works to the original bill:
1. Removes proposed law which would specify that an applicant may request a
personalized plate to be issued at no additional cost to the applicant.
2. Removes present law which provides that a royalty fee is to be paid to each
institution for the use of the university's or college's design and removes
references to such royalty fee.
