HOUSE BILL NO. 633

ALCOHOLIC BEVERAGES:  Provides relative to size limitations on containers of wine
sold or shipped in this state
1	AN ACT
2To amend and reenact R.S. 26:351(2)(a) and (4)(a)(introductory paragraph), relative to the
3 size of containers for beverages of high alcoholic content; to provide relative to the
4 container sizes for certain alcoholic beverages sold or shipped in the state; to provide
5 relative to the container size and configuration in each shipping case or container;
6 and to provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 26:351(2)(a) and (4)(a)(introductory paragraph) are hereby amended
9and reenacted to read as follows: 
10 ยง351.  Limitation on size of containers of beverages of high alcoholic content;
11	standards of fill
12	Except for wines, no manufacturer or wholesaler in this state shall have in his
13 possession any beverages of high alcoholic content outside of his bonded stockroom
14 unless they are in containers of no greater capacity than 1.75 liters.  The standards
15 of fill shall be the following:

17	(2)(a)  All wine, sold in or shipped into this state shall be in the following
18 containers: twenty liters, nineteen and five-tenths liters, eighteen liters, seventeen
19 liters, sixteen liters, fifteen liters, fourteen liters, thirteen liters, twelve liters, eleven
20 liters, ten liters, nine liters, eight liters, seven liters, six liters, five liters, four liters,

1 three liters, one and five-tenths liters, one liter, seven hundred fifty milliliters, five
2 hundred milliliters, three hundred seventy-five milliliters, three hundred fifty-five
3 milliliters, one hundred eighty-seven milliliters, or any other size permitted by
4 applicable federal law.

6	(4)(a)  Wines bottled subject to the standards of fill prescribed in Paragraph
7 (2) of this Subsection shall be packed with the following number of containers per
8 shipping case or shipping container, or any other container size and configuration
9 permitted by applicable federal law:

Abstract:  Authorizes the shipping of wine in containers, the size and configuration of
which are permitted by federal law.
Present law provides that all wine sold or shipped into this state shall be in certain sized
containers.

Proposed law retains present law and authorizes wine to be shipped in any other size
permitted by applicable federal law.
Present law requires that wines bottled subject to the standards provided for in present law
be packed with a certain number of bottles per shipping case or shipping container and
further provides for the container size and the containers per case.
Proposed law retains present law and authorizes wine to be shipped in any other container
size and configuration permitted by applicable federal law.
