HOUSE BILL NO. 718

HEALTH CARE/FACILITIES:  Requires certain licensed medical facilities to be equipped
with backup generators
1	AN ACT
2To enact Part I-A of Chapter 11 of Title 40 of the Louisiana Revised Statutes of 1950, to be
3 comprised of R.S. 40:2050, relative to licensed medical facilities; to require certain
4 licensed medical facilities to maintain certain emergency equipment; to provide for
5 annual certification; to authorize a fine for violation; to provide for an effective date;
6 and to provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  Part I-A of Chapter 11 of Title 40 of the Louisiana Revised Statutes of
91950, to be comprised of R.S. 40:2050, is hereby enacted to read as follows: 
10	PART I-A EMERGENCY PLANNING STANDARDS
11 §2050.  Licensed facilities; backup generator
12	Every facility licensed pursuant to the provisions of this Chapter shall be
13 equipped with an operable backup generator of sufficient size to support and
14 maintain necessary life-sustaining medical equipment.  The Department of Health
15 and Hospitals shall verify annually that each licensed facility is operating in
16 compliance with these provisions.  Any licensed facility found to be operating
17 without the equipment required by this Section shall be assessed a fine of five
18 thousand dollars.

1 Section 2.  This Act shall become effective on July 1, 2016; if vetoed by the governor
2and subsequently approved by the legislature, this Act shall become effective on July 1,
32016, or on the day following such approval by the legislature, whichever is later.

Abstract:  Requires certain medical facilities to be equipped with operable backup
generators.
Proposed law requires facilities licensed pursuant to the provisions of this Chapter shall be
equipped with an operable backup generator of sufficient size to support and maintain
necessary life-sustaining medical equipment.  Further requires annual verification by the
Dept. of Health and Hospitals and a $5K fine for noncompliance.
Present law  requires licensing for the following medical facilities:
(1)Hospitals
(2)Home Health Care Providers
(3)End Stage Renal Disease Facilities
(4)Home and Community-Based Service Providers
(5)Adult Day Care Providers
(6)Adult Brain Injury Facilities
(7)Adult Day Health Care Providers
(8)Nursing Facilities and Skilled Nursing Facility Units
(9)Ambulatory Surgical Centers 
• Behavioral Health Services Providers
(10)Adult Residential Care Providers
(11)Trauma Centers
(12)Outpatient Abortion Facilities
(13)Intermediate Care Facilities for Persons with Developmental Disabilities
(14)Crisis Receiving Centers
(15)Hospices
(16)Pediatric Day Health Care Facilities
