HOUSE BILL NO. 773

COURTS/COURT COSTS:  Provides for court costs collected in criminal cases
1	AN ACT
2To enact R.S. 13:1000.7, relative to court costs; to provide for court costs collected in the
3 Nineteenth Judicial District Court and Juvenile Court of East Baton Rouge Parish;
4 to provide for use of proceeds; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 13:1000.7 is hereby enacted to read as follows: 
7 ยง1000.7.  Criminal matters; additional costs in East Baton Rouge Parish
8	A.  In all criminal cases, including traffic offenses, of which the Nineteenth
9 Judicial District Court and Juvenile Court of East Baton Rouge Parish have
10 jurisdiction, there shall be assessed as additional costs against every defendant who
11 is convicted after trial or who pleads guilty or forfeits bond, the sum of ten dollars
12 to the Nineteenth Judicial District Court Building Commission or ten dollars to the
13 Juvenile Court of East Baton Rouge Parish as applicable.  These costs shall be in
14 addition to all other fines, costs, or forfeitures lawfully imposed and shall be
15 transmitted  to the sheriff of East Baton Rouge Parish and all sums collected shall be
16 expended pursuant to the order of the judges of the respective courts, en banc.
17	B.  No defendant shall be assessed costs pursuant to Subsection A of this
18 Section in excess of ten dollars.

1	C.  The provisions of this Section shall be null, void, and of no effect on and
2 after August 1, 2021.
3 Section 2.  The provisions of R.S. 13:1000.7 are hereby repealed in their entirety.
4 Section 3.  The provisions of this Section and Section 1 of this Act shall become
5effective August 1, 2016.  The provisions of Section 2 of this Act shall become effective
6August 1, 2021.

Present law provides for court costs in criminal and juvenile matters.
Proposed law retains present law.  Provides for additional court costs in the amount of $10
to the 19
th
 Judicial District Court Building Commission or $10 to the Juvenile Court of East
Baton Rouge Parish, as applicable. 
The additional court cost authorized by proposed law will expire on or after Aug. 1, 2021.

Summary of Amendments Adopted by House
The Committee Amendments Proposed by House Committee on Judiciary to the original
bill:
1. Add that no defendant shall be assessed costs pursuant to proposed law in excess
of $10.
The House Floor Amendments to the engrossed bill:
1. Add that the additional court cost under proposed law will expire  on or after
Aug. 1, 2021.
