R.S. 22:1062(D)(1)(introductory paragraph) is hereby amended and 8reenacted to read as follows: 9 ยง1062. Increased portability through limitation on preexisting condition exclusions 10 * * * 11 D.(1) A group health plan, and a health insurance issuer offering group 12 health insurance coverage, shall provide send the certification of the period of 13 creditable coverage no more than twenty days after such certification is requested by 14 an individual who ceases to be covered under the issuer's policy or plan: 15 * * * 16 Section 2. This Act shall become effective upon signature by the governor or, if not 17signed by the governor, upon expiration of the time for bills to become law without signature 18by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 19vetoed by the governor and subsequently approved by the legislature, this Act shall become 20effective on the day following such approval. Present law requires a group health plan, and a health insurance issuer offering group health coverage, to provide certification of the period of creditable coverage when an individual ceases to be covered under the plan. Proposed law instead requires that such certification of creditable coverage be sent no more than 20 days after it is requested by an individual who ceases to be covered under the issuer's policy or plan. Effective upon signature of governor or lapse of time for gubernatorial action. (Amends R.S. 22:1062(D)(1)(intro. para.))
