ENROLLED 2016 Regular Session HOUSE BILL NO. 85 BY REPRESENTATIVE DAVIS 1 AN ACT 2 To amend and reenact R.S. 33:9097.8(B), relative to the Broadmoor Crime Prevention and 3 Improvement District in East Baton Rouge Parish; to modify the boundaries of the 4 district subject to voter approval; and to provide for related matters. 5 Notice of intention to introduce this Act has been published 6 as provided by Article III, Section 13 of the Constitution of 7 Louisiana. 8 Be it enacted by the Legislature of Louisiana: 9 Section 1. R.S. 33:9097.8(B) is hereby amended and reenacted to read as follows: 10 ยง9097.8. Broadmoor Crime Prevention and Improvement District 11 * * * 12 B.(1) Boundaries. The boundaries of the district shall include all the 13 property within, and no property outside of, the following subdivisions in East Baton 14 Rouge Parish as established by the official subdivision plats thereof filed with the 15 clerk of court of East Baton Rouge Parish: Broadmoor, East Broadmoor, North 16 Broadmoor Circle, Broadmoor Oaks, Broadmoor Place, Broadmoor Terrace, Oak 17 Hill, South Broadmoor, Clarice Browning Arnold Tract, and Broadmoor Estates. In 18 addition, the district shall include lots B-4-1, B-4-2, and B-4-3 and Lot M of the 19 Edmund R. Sharp Property as shown by the official records of the clerk of court of 20 East Baton Rouge Parish. HB NO. 85 ENROLLED 1 (2) Notwithstanding the provisions of Paragraph (1) of this Subsection, the 2 boundaries of the district shall also include North Broadmoor if the question of 3 expansion and imposition of the parcel fee, which was approved by the registered 4 voters of the district on November 6, 2012, and expires in 2022, is approved by a 5 majority of the registered voters in North Broadmoor voting on the proposition at an 6 election held for that purpose in accordance with the Louisiana Election Code. No 7 less than thirty days prior to any election held to approve such expansion and parcel 8 fee, the board of commissioners shall mail notification of the upcoming election to 9 each registered voter in North Broadmoor and to the owner of a parcel in North 10 Broadmoor if the owner is not a registered voter in North Broadmoor. If the 11 inclusion of North Broadmoor within the district and the imposition of the parcel fee 12 are approved as provided in this Paragraph, the boundaries of the district shall be 13 expanded to include North Broadmoor effective on January first following the 14 election. The district shall begin providing services in North Broadmoor after 15 receiving payment of parcel fees from North Broadmoor property owners. 16 * * * 17 Section 2. This Act shall become effective upon signature by the governor or, if not 18 signed by the governor, upon expiration of the time for bills to become law without signature 19 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 20 vetoed by the governor and subsequently approved by the legislature, this Act shall become 21 effective on the day following such approval.
