HOUSE BILL NO. 857

TRANSPORTATION DEPT:  Requires employees or representatives of the Dept. of
Transportation and Development to comply with a contractor's safety and
environmental plan on department projects
1	AN ACT
2To enact R.S. 48:251(E), relative to  contracts let by the Department of Transportation and
3 Development; to require that the Department of Transportation and Development
4 employees abide by a contractor's safety and environmental plan; to provide that a
5 contractor shall not be liable for injuries sustained by a Department of Transportation
6 and Development employee who fails to abide by a contractor's safety and
7 environmental plan; and to provide for related matters.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 48:251(E) is hereby enacted to read as follows:
10 ยง251.  Contracts for projects

12	E.  Every contract of the department shall provide that all employees of the
13 department shall abide by the safety and environmental plan of a contractor while on
14 a job site.  Notwithstanding any provision of law to the contrary, every contract of
15 the department shall provide that the contractor shall not be liable for injuries
16 sustained by any department employee while on a job site due to the employee's
17 failure to abide by the safety and environmental plan of a contractor.

of a contractor while on a job site.
Proposed law provides that, notwithstanding any provision of law to the contrary, every
contract of the Dept. of Transportation and Development shall provide that the contractor
shall not be liable for injuries sustained by department employees while on a job site due to
the employee's failure to abide by the safety and environmental plan of a contractor.
