[R.S. 1:13(B) and 24:177(E)] HB 888 Reengrossed 2016 Regular Session Pierre Abstract: Modifies the notice requirement dealers who sell trade-in vehicles must follow for canceled license plates. Also, extends the notice requirement to canceled license plates for leased vehicles. Present law requires any dealer of motor vehicles who receives a previously owned vehicle with the intention of reselling such vehicle to remove the license plate from that vehicle and execute an affidavit attesting to that fact and attach said affidavit to the title and registration. Provides that the knowing submission of a false affidavit is a false swearing under present law (R.S. 14:125). Proposed law modifies present law by requiring the dealer to remove the license plate and submit an electronic notification, instead of an affidavit attesting to the removal of the license plate, to the Dept. of Public Safety and Corrections, which states he has received the vehicle, removed the license or number plate from such vehicle, and intends to resell the vehicle. Also, extends the notice requirement for canceled license plates in present law to leased vehicles. Clarifies that the knowing submission of a false electronic notification is a false swearing under present law (R.S. 14:125). (Amends R.S. 47:505(B)(2)) Summary of Amendments Adopted by House The Committee Amendments Proposed by House Committee on Transportation, Highways and Public Works to the original bill: 1. Clarify a reference to department as the Department of Public Safety and Corrections. The House Floor Amendments to the engrossed bill: 1. Eliminate references to submission of affidavits and specify that electronic notification must be submitted by a dealer to the Dept. of Public Safety and Corrections and contain a statement that he has received the vehicle, removed the license or number plate from such vehicle, and that he intends to resell the vehicle. Also, require the dealer to attach the title and registration to the electronic notification. 2. Clarify that the knowing submission of a false electronic notification, instead of an affidavit, is a false swearing under present law.
