HLS 16RS-302 ORIGINAL 2016 Regular Session HOUSE BILL NO. 904 BY REPRESENTATIVE BILLIOT RETIREMENT/MUNICIPAL EMP: Provides an exception to the earnings limitation applicable to a reemployed retiree of the Municipal Employees' Retirement System 1 AN ACT 2To amend and reenact R.S. 11:1762(B), relative to reemployed retirees of the Municipal 3 Employees' Retirement System; to provide relative to the retirement benefits such 4 a person may receive; and to provide for related matters. 5 Notice of intention to introduce this Act has been published 6 as provided by Article X, Section 29(C) of the Constitution 7 of Louisiana. 8Be it enacted by the Legislature of Louisiana: 9 Section 1. R.S. 11:1762(B) is hereby amended and reenacted to read as follows: 10 ยง1762. Reemployment of retirees 11 * * * 12 B.(1) Whenever Except as provided in Paragraph (2) of this Subsection, if 13 a retired member receiving normal retirement benefits becomes reemployed by an 14 employer such that his monthly earnings exceed the difference between his monthly 15 average final compensation and his monthly retirement benefit, his retirement 16 benefits shall be reduced by the amount his monthly earnings exceed the difference 17 between his monthly average final compensation and his monthly retirement benefit 18 for every month of such employment and he shall not be a member of the system. 19 (2) An operator of a water supply system or a sewerage system who has been 20 certified pursuant to R.S. 40:1281.1 et seq. may return to work in such a position for Page 1 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. This Act shall become effective on July 1, 2016; if vetoed by the governor 5and subsequently approved by the legislature, this Act shall become effective on July 1, 62016, or on the day following such approval by the legislature, whichever is later. [R.S. 1:13(B) and 24:177(E)] HB 904 Original 2016 Regular Session Billiot Abstract: Provides an exception, applicable to certified water and sewerage system operators, to a required reduction in retirement benefits for reemployed retirees from the Municipal Employees' Retirement System (MERS). Present law provides that during a period of reemployment of a retiree of MERS, his employment income plus his retirement benefit may not exceed his average final compensation; if it does, his retirement benefit is reduced by the excess amount. Proposed law retains present law except to provide that the required reduction in benefits does not apply to a certified operator of a water supply or sewerage system who returns to work in such a position. Limits this exception to not more than a lifetime total of three years. Effective July 1, 2016.
