CHILDREN/CARE: Revises the weekly hours of operation that qualify a facility for
definition as a child day care center and full-time child day care center
1 AN ACT
2To amend and reenact R.S. 17:407.33(A)(3), relative to child day care centers; to revise the
3 number of hours a center shall operate weekly in order to meet the definition of child
4 day care center and full-time child day care center; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 17:407.33(A)(3) is hereby amended and reenacted to read as follows:
7 ยง407.33. Definitions
8 A. As used in this Part, the following definitions shall apply unless the
9 context clearly states otherwise:

11 (3) "Child day care center" means any place or facility operated by any
12 institution, political subdivision, society, agency, corporation, person or persons, or
13 any other group for the purpose of providing care, supervision, and guidance of
14 seven or more children, not including those related to the caregiver, unaccompanied
15 by parent or legal custodian, on a regular basis for at least twelve and one-half three
16 hours in a continuous seven-day week. If a child day care center provides
17 transportation or arranges for transportation to and from the center, either directly or
18 by contract with third parties, all hours during which a child is being transported
19 shall be included in calculating the hours of operation. A child day care center that
20 remains open for more than twelve and one-half three hours in a continuous

1 seven-day week, and in which no individual child remains for more than twenty-four
2 hours in one continuous stay shall be known as a full-time child day care center. A
3 child day care center that remains open after 9:00 p.m. shall meet the regulations
4 established for nighttime care.

Abstract: Reduces the minimum number of weekly hours of operation qualifying a facility
as a child day care center from 12.5 to three.
Present law provides for the licensing and regulation of child day care centers by the state
Dept. of Education. Present law defines a child day care center as a facility providing care
for at least seven children for at least 12.5 hours per week. Proposed law reduces the
minimum number of hours a facility must operate weekly to meet this definition from 12.5
to three.
Present law provides that a child day care center that remains open for more than 12.5 hours
in a week is considered "full-time". Proposed law lowers this "full-time" threshold from
12.5 hours to three hours.
