HLS 16RS-1419 ENGROSSED 2016 Regular Session HOUSE BILL NO. 922 BY REPRESENTATIVE HENSGENS NURSING HOMES: Revises provider fees assessed on nursing homes by the Department of Health and Hospitals 1 AN ACT 2To amend and reenact R.S. 46:2625(A)(1)(introductory paragraph) and (a) and to repeal R.S. 3 46:2625(B), relative to fees on healthcare providers; to revise the fee amount for 4 nursing homes; to repeal a prohibition on new fees or increased fees on nursing 5 homes without a majority vote of approval by the legislature; and to provide for 6 related matters. 7Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 46:2625(A)(1)(introductory paragraph) and (a) are hereby amended 9and reenacted to read as follows: 10 ยง2625. Fees on health care healthcare providers; disposition of fees 11 A.(1) The Department of Health and Hospitals is hereby authorized to adopt 12 and impose fees for health care healthcare services provided by the Medicaid 13 program on every nursing facility, every intermediate care facility for people with 14 developmental disabilities, every pharmacy in the state of Louisiana and certain out- 15 of-state pharmacies, dispensing physicians, and medical transportation providers. 16 The amount of any fee shall not exceed the total cost to the state of providing the 17 health care healthcare service subject to such fee. In addition, the amount of the fees 18 imposed under the rules and regulations adopted shall not exceed the following: 19 (a) Ten dollars per occupied bed per day for nursing facilities. Present law establishes fees to be imposed on certain healthcare service providers. Present law further sets the maximum fee for nursing facilities at $10.00 per occupied bed per day. Proposed law changes the maximum fee amount to the percentage of net patient service revenues permitted by federal regulations as determined by the Dept. of Health and Hospitals (DHH) on a per occupied bed per day basis. Present law prohibits DHH from imposing any new fee or increasing any fee on any nursing home without prior approval of the specific fee amount by record vote of a majority of the elected members of each house of the legislature while in session.
