Abstract:  Prohibits the creation of new employment positions in the executive and legislative
branches of state government from August 1, 2016, through June 30, 2018.
Proposed law prohibits any agency as defined in present law (R.S. 39:2) or agent of the agency from
creating a new employment position in the executive branch of state government.  Proposed law
exempts institutions of higher education and their management boards from the prohibition.  Present
law defines "agency" as any state office, department, board, commission, institution, division, officer
or other person, or functional group, heretofore existing or hereafter created, that is authorized to
exercise, or that does exercise, any functions of the government of the state in the executive branch,
but not any governing body or officer of any local government or subdivision of the state, or any
parochial officer who exercises functions coterminous with the municipality in which he performs
those functions.
Proposed law prohibits any house, official, committee, employee, or other entity or agent of the
legislative branch of state government from creating a new employment position in the legislative
branch of state government.
Proposed law provides that the provisions of proposed law shall be inapplicable, inoperative, and
of no effect after June 30, 2018.
Effective August 1, 2016; except repeal of proposed law effective July 1, 2018.

Summary of Amendments Adopted by House
The Committee Amendments Proposed by House Committee on Appropriations to the original
bill:
1. Remove prohibition on filling vacant positions and creating new positions by the judicial
branch of state government.
2. Remove prohibition on filling vacant positions in the executive branch and the legislative
branch.
3. Add an exemption to proposed law for institutions of higher education and their management boards.
4. Change effective date from July 1, 2016, to August 1, 2016.
