HOUSE BILL NO. 969

PUBLIC HEALTH:  Requires adult residential care providers and nursing homes to
disseminate information on shingles and pneumonia immunizations
1	AN ACT
2To enact R.S. 40:2011 and 2166.9, relative to immunizations for adults; to require nursing
3 homes and adult residential care providers to disseminate educational information
4 on shingles and pneumonia; to establish the minimum content of the information; to
5 provide for interpretations; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 40:2011 and 2166.9 are hereby enacted to read as follows: 
8 §2011.  Immunization information; shingles; pneumonia
9	A.  No later than September first of each year and in accordance with the
10 latest recommendations of the Advisory Committee on Immunization Practices of
11 the Centers for Disease Control and Prevention, every licensed nursing home shall
12 provide residents educational information on zoster, also known as shingles.  This
13 educational information shall include, at a minimum, the risks associated with
14 shingles, the availability, effectiveness, and known contraindications of the shingles
15 immunization, the causes and symptoms of shingles, and the means by which the
16 varicella-zoster virus is spread.
17	B.  No later than September first of each year and in accordance with the
18 latest recommendations of the Advisory Committee on Immunization Practices of
19 the Centers for Disease Control and Prevention, every licensed nursing home shall
20 provide residents educational information on pneumonia.  This educational

1 information shall include, at a minimum, the risks associated with pneumonia, the
2 availability, effectiveness, and known contraindications of the pneumococcal
3 immunization, the causes and symptoms of pneumonia, and the means by which
4 pneumonia is spread.
5	C.  Nothing in this Section shall be construed to require any licensed nursing
6 home to provide or pay for any immunization against the varicella-zoster virus or
7 pneumonia.

Abstract:  Requires nursing homes and adult residential care providers to disseminate
educational information on shingles and pneumonia.
Proposed law requires nursing homes and adult residential care providers to provide
educational information on shingles and pneumonia no later than Sept. 1 of each year and
in accordance with the latest recommendations of the Advisory Committee on Immunization
Practices of the Centers for Disease Control and Prevention.
Proposed law requires the educational information to include, at a minimum, all of the
following:
(1)The risks associated with shingles and pneumonia.
(2)The availability, effectiveness, and known contraindications of the shingles and
pneumococcal immunizations.
(3)The causes and symptoms of shingles and pneumonia.
(4)The means by which the varicella-zoster virus and pneumonia are spread.
Proposed law shall not be construed to require any nursing home or adult residential care
provider to provide or pay for any immunization against the varicella-zoster virus or
pneumonia.
