HOUSE BILL NO. 969
BY REPRESENTATIVES COX, BAGLEY, HENSGENS, HOFFMANN, HORTON, MIKE
JOHNSON, MAGEE, AND DUSTIN MILLER
PUBLIC HEALTH:  Requires adult residential care providers and nursing homes to
disseminate information on shingles and pneumonia immunizations
1	AN ACT
2To enact R.S. 40:2011 and 2166.9, relative to immunizations for adults; to require the
3 Department of Health and Hospitals to provide educational information on shingles
4 and pneumonia; to require nursing homes and adult residential care providers to
5 disseminate educational information on shingles and pneumonia; to establish the
6 minimum content of the information; to provide for interpretations; and to provide
7 for related matters.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 40:2011 and 2166.9 are hereby enacted to read as follows: 
10 §2011.  Immunization information; shingles; pneumonia
11	A.  No later than September first of each year and in accordance with the
12 latest recommendations of the Advisory Committee on Immunization Practices of
13 the Centers for Disease Control and Prevention, the Department of Health and
14 Hospitals shall provide to licensed nursing homes with educational information on
15 zoster, also known as shingles.  The educational information shall include, at a
16 minimum, the risks associated with shingles and how to protect oneself against the
17 varicella-zoster virus.  The licensed nursing homes shall disseminate this information
18 to their residents.

1	B.  No later than September first of each year and in accordance with the
2 latest recommendations of the Advisory Committee on Immunization Practices of
3 the Centers for Disease Control and Prevention, the Department of Health and
4 Hospitals shall provide nursing facilities with educational information on
5 pneumonia.  The educational information shall include, at a minimum, the risks
6 associated with pneumonia and the availability of the pneumococcal immunization.
7 The licensed nursing homes shall disseminate this information to their residents.
8	C.  Nothing in this Section shall be construed to require any licensed nursing
9 home to provide or pay for any immunization against the varicella-zoster virus or
10 pneumonia.

Abstract:  Requires nursing homes and adult residential care providers to disseminate
educational information on shingles and pneumonia.
Proposed law requires the Dept. of Health and Hospitals to provide nursing homes and adult
residential care providers with educational information on shingles and pneumonia no later
than Sept. 1 of each year and in accordance with the latest recommendations of the Advisory
Committee on Immunization Practices of the Centers for Disease Control and Prevention.
Proposed law requires the educational information to include, at a minimum, all of the
following:
(1)The risks associated with shingles and how to protect oneself against the varicella-
zoster virus. 
(2)The risks associated with pneumonia and the availability of the pneumococcal
immunization.
Proposed law requires the nursing homes and adult residential care providers to disseminate
the educational information to their residents.
Proposed law shall not be construed to require any nursing home or adult residential care
provider to provide or pay for any immunization against the varicella-zoster virus or
pneumonia.

Summary of Amendments Adopted by House
The Committee Amendments Proposed by House Committee on Health and Welfare to
the original bill:
1. Require DHH to provide the educational information to licensed nursing homes
and adult residential care providers.
2. Limit the minimum required content of the educational material provided by
DHH.
3. Make technical changes.
