HLS 16RS-1997 ORIGINAL 2016 Regular Session HOUSE BILL NO. 989 BY REPRESENTATIVE SHADOIN HIGHER EDUCATION: Provides relative to tuition and fees applicable to nonresident students 1 AN ACT 2To amend and reenact R.S. 17:3351(A)(5)(b)(i), relative to nonresident tuition and fees at 3 public postsecondary education institutions; to remove limitations on the tuition and 4 fee amounts; and to provide for related matters. 5Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 17:3351(A)(5)(b)(i) is hereby amended and reenacted to read as 7follows: 8 ยง3351. General powers, duties, and functions of postsecondary education 9 management boards 10 A. Subject only to the powers of the Board of Regents specifically 11 enumerated in Article VIII, Section 5 of the Constitution of Louisiana, and as 12 otherwise provided by law, each postsecondary system management board as a body 13 corporate shall have authority to exercise power necessary to supervise and manage 14 the day-to-day operations of institutions of postsecondary education under its 15 control, including but not limited to the following: 16 * * * 17 (5) 18 * * * 19 (b)(i)(aa) In accordance with Article VII, Section 2.1 of the Constitution of 20 Louisiana, each management board also shall have authority to establish tuition and 21 mandatory attendance fee amounts applicable to nonresident students at an Page 1 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 16RS-1997 ORIGINAL HB NO. 989 1 institution under its supervision and management that at least equal the average 2 amount of annual tuition and mandatory attendance fees for the ensuing fiscal year 3 applicable to nonresident students, at institutions in states comprising the Southern 4 Regional Education Board, excluding Louisiana, which are in the same category as 5 established by the Southern Regional Education Board. Such amounts shall be based 6 on the latest available information that is obtainable by the Board of Regents from 7 the regional education board. 8 (bb) Notwithstanding the provisions of Subitem (aa) of this Item, the Board 9 of Supervisors of Southern University and Agricultural and Mechanical College and 10 the Board of Supervisors for the University of Louisiana System may reduce tuition 11 and mandatory attendance fee amounts applicable to nonresident undergraduate 12 students at historically black colleges and universities under the supervision and 13 management of the respective board to an amount not less than the average amount 14 of annual tuition and mandatory attendance fees applicable to resident undergraduate 15 students at the same institution. (SREB). Present law authorizes the management boards of the public postsecondary education systems to establish tuition and mandatory attendance fee amounts applicable to nonresident students at their respective institutions. Proposed law retains present law. Present law requires that tuition and fee amounts for nonresident students be at least equal to the average amount of annual tuition and mandatory attendance fees for nonresident students at peer institutions in states comprising the SREB, excluding La. Present law provides an exception to this requirement for historically black colleges and universities. Proposed law removes the requirement and the exception.
