HLS 16RS-1762 ORIGINAL 2016 Regular Session HOUSE BILL NO. 997 BY REPRESENTATIVE THIBAUT INSURANCE/GROUP-STATE: Provides with respect to self-insured group health plans offered by the Office of Group Benefits 1 AN ACT 2To enact R.S. 42:802.2, relative to the Office of Group Benefits; to provide for the powers, 3 duties, and functions of the office with respect to self-insured group health plans; 4 to require the prior approval of certain schedule of benefits; to require certain 5 information to be published; and to provide for related matters. 6Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 42:802.2 is hereby enacted to read as follows: 8 ยง802.2. Self-insured group health plans; reporting of plans, rates, and benefits 9 A. The Office of Group Benefits shall make available a summary of benefits 10 and coverage for each self-insured group health plan offered by the Office of Group 11 Benefits in accordance with applicable federal law. The Office of Group Benefits 12 shall provide the summary to any plan member who requests a copy. 13 B. Any new schedule of benefits for a self-insured group health plan offered 14 through the Office of Group Benefits and promulgated in the Office of Group 15 Benefits regulations shall be subject to review and prior approval by the appropriate 16 standing committee of the legislature having jurisdiction of review of agency rules 17 by the Office of Group Benefits as designated by R.S. 49:968(B)(21)(c) or the 18 subcommittee on oversight of the standing committee. 19 C. The Office of Group Benefits shall publish on its website the following: 20 (1) The summary of benefits and coverage for each self-insured group health 21 plan as required by Subsection A of this Section. Any modifications to plan documents for self-insured group health plans 4 offered by the Office of Group Benefits shall be in accordance with applicable state 5 and federal laws. 6 E. The Office of Group Benefits shall provide all premium rates and any 7 changes to premium rates for the self-insured group health plans offered by the 8 Office of Group Benefits to the Group Benefits Estimating Conference, the Group 9 Benefits Policy and Planning Board, and the independent consulting actuary retained 10 by or on behalf of the Office of Group Benefits in accordance with applicable state 11 law. Proposed law requires OGB to publish on its website the summary of benefits and coverage required under proposed law and the plan documents for each self-insured group health plan offered by OGB.
