HOUSE CONCURRENT RESOL UTION NO. 34
BY REPRESENTATIVE HOFFMANN
LEGISLATIVE AGCY/LAW INST:  Requests completion of a study regarding continuing
contact by parents and other relatives with children in need of care
1	A CONCURRENT RESOL UTION
2To continue legislative authority for and request completion of a study by the Children's
3 Code Committee of the Louisiana State Law Institute relative to continuing contact
4 by parents and other relatives with children who are subjects of child in need of care
5 proceedings as originally provided in House Concurrent Resolution No. 125 of the
6 2015 Regular Session.
7 WHEREAS, in House Concurrent Resolution No. 125 of the 2015 Regular Session,
8referred to hereafter as "HCR No. 125", the legislature called upon the Children's Code
9Committee of the Louisiana State Law Institute to study laws and policies relative to
10continuing contact by parents and other relatives with children who are subjects of legal
11proceedings known as "child in need of care proceedings" which are brought by the state to
12protect children who are abused, neglected, abandoned, or endangered; and
13 WHEREAS, HCR No. 125 called upon the Children's Code Committee to report to
14certain legislative committees prior to the convening of the 2016 Regular Session its
15recommendations for any changes to laws and policies which would promote the safety and
16well-being of children who are subjects of child in need of care proceedings; and
17 WHEREAS, as of the date of filing of this Resolution, the Children's Code
18Committee has met numerous times to develop the study called for in HCR No. 125, and has
19formed a special subcommittee to focus exclusively on the subject matter addressed in that
20instrument; and

1 WHEREAS, according to an interim report that the Children's Code Committee
2issued prior to the convening of the 2016 Regular Session, while the committee has
3identified several issues and deficiencies under current state laws and policies relative to
4continuing contact by parents and other relatives with children who are subjects of child in
5need of care proceedings, its efforts to complete the report called for in HCR No. 125 are
6still ongoing.
7 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby
8commend the Children's Code Committee of the Louisiana State Law Institute for making
9progress in the challenging and momentous task of formulating potential changes to laws
10and policies which would promote the safety and well-being of our state's most vulnerable
11children.
12 BE IT FURTHER RESOLVED that the Legislature of Louisiana does hereby
13continue legislative authority for the study by the Children's Code Committee concerning
14laws and policies relative to continuing contact by parents and other relatives with children
15who are subjects of child in need of care proceedings as called for in House Concurrent
16Resolution No. 125 of the 2015 Regular Session.
17 BE IT FURTHER RESOLVED that the Legislature of Louisiana does hereby request
18that the Children's Code Committee complete the study called for in House Concurrent
19Resolution No. 125 of the 2015 Regular Session, and report its findings and
20recommendations for any changes to laws and policies which would promote the safety and
21well-being of children to the House Committee on Health and Welfare, the Senate
22Committee on Health and Welfare, the House Committee on the Administration of Criminal
23Justice, and the Senate Committee on Judiciary A no later than sixty days prior to the
24convening of the 2017 Regular Session.
25 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
26director of the Louisiana State Law Institute and the secretary of the Department of Children
27and Family Services.
