HLS 16RS-4574 ORIGINAL 2016 Regular Session HOUSE RESOLUTION NO. 192 BY REPRESENTATIVE TERRY LANDRY MOTOR VEHICLES: Urges and requests the Department of Public Safety and Corrections, public safety services, to make any necessary improvements to the system by which records of information are received from security providers 1 A RESOLUTION 2To urge and request the Department of Public Safety and Corrections, public safety services, 3 to make any necessary improvements to the system by which records of information 4 are received from security providers. 5 WHEREAS, the Motor Vehicle Safety Responsibility Law, R.S. 32:851 et seq., 6requires that every motor vehicle registered in the state of Louisiana be covered by a motor 7vehicle liability policy or a motor vehicle liability bond, hereinafter referred to as "security"; 8and 9 WHEREAS, all entities providing security, hereinafter referred to as "security 10providers", are required to notify the Department of Public Safety and Corrections, public 11safety services, of the effective dates of each liability policy, liability bond, deposit, or other 12security within fifteen business days from the date that notice of such policy, bond, deposit, 13or other security was issued; and 14 WHEREAS, in addition, all such security providers are required to notify the 15Department of Public Safety and Corrections, public safety services, when any policy, bond, 16deposit, or other item of security is terminated, withdrawn, canceled, lapsed, or otherwise 17made ineffective within fifteen business days from the date that notice of the security 18becoming ineffective was issued by the security provider; and 19 WHEREAS, when a security provider does not provide the Department of Public 20Safety and Corrections, public safety services, with information regarding terminations and Page 1 of 3 HLS 16RS-4574 ORIGINAL HR NO. 192 1other grounds rendering a security item ineffective within the time limits set forth by law, 2the security provider is required to pay a late fee of not more than fifty dollars per policy, 3bond, or deposit, or other security item concerning which information is not supplied; and 4 WHEREAS, if the security provider has reported terminations and other grounds 5rendering a security item ineffective in an untimely manner, the Department of Public Safety 6and Corrections, public safety services, is required to impose the late fee unless it is 7determined that the security provider made a good faith effort to comply with these 8requirements but the delay was caused by circumstances outside the security provider's 9control; and 10 WHEREAS, the Department of Public Safety and Corrections, public safety services, 11is required to keep a record of the information received from security providers concerning 12coverage of vehicles and persons by security, which information may be stored through 13automated electronic data processing means; and 14 WHEREAS, these late fees are imposed on security providers in many instances, but 15in many other instances determinations cannot be made on whether the information was 16timely submitted or not due to problems with the system by which security providers report 17terminations and other grounds rendering a security item ineffective. 18 THEREFORE, BE IT RESOLVED that the House of Representatives of the 19Legislature of Louisiana does hereby urge and request the Department of Public Safety and 20Corrections, public safety services, to make any necessary improvements to the system by 21which records of information are received from security providers concerning coverage of 22vehicles and persons so that the appropriate fees can be collected from security providers 23who fail to timely notify the department when any policy, bond, deposit, or other item of 24security is terminated, withdrawn, canceled, lapsed, or otherwise made ineffective. 25 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 26Department of Public Safety and Corrections, public safety services.
