(gov sig) 1 AN ACT 2 To amend and reenact R.S. 40:39.1(A)(1) and (B)(1) and 46(C) and to repeal R.S. 40:39 and 3 40(1), relative to vital records; to provide for elimination of the short-form birth 4 certificate; to provide for repeal of the fee for the short-form birth certificate; to 5 provide for an effective date; and to provide for related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 40:39.1(A)(1) and (B)(1) and 46(C) are hereby amended and 8 reenacted to read as follows: 9 §39.1. Certified copies of birth certificates and death certificates; clerks of district 10 courts and the Second City Court of the city of New Orleans; Vital 11 Records Conversion Fund 12 A. The state registrar of vital records shall promulgate rules to implement the 13 issuance of certified copies of birth certificates and death certificates through the 14 office of the clerk of district court in each parish and the office of clerk of the Second 15 City Court of the city of New Orleans. SB NO. 106 SLS 16RS-370 ORIGINAL 1 items: 2 (1) Automated access, retrieval, and production of short-form birth 3 certificates, long-form birth certificates, and death certificates by the clerks of district 4 courts and the clerk of the Second City Court of the city of New Orleans using the 5 data network available to the secretary of state. 6 * * * 7 B.(1) The clerk of district court in each parish and the clerk of the Second 8 City Court of the city of New Orleans may issue certified copies of short-form birth 9 certificate cards and long-form birth certificates and death certificates in accordance 10 with rules promulgated pursuant to Subsection A of this Section. In addition to fees 11 collected for issuance of a birth record or death certificate as provided in R.S. 40:40, 12 the clerk of court shall collect a fee of five dollars for a short-form birth certificate 13 and nine dollars for a long-form birth certificate or a death certificate. 14 * * * 15 §46. New certificate of birth when judgment of filiation is obtained 16 * * * 17 C. The new certificate of birth shall be signed by the child's father prior to its 18 recordation in the vital records registry and only after such signing and recordation 19 may certified copies or short form birth certification cards be issued as in the case 20 of all other birth records. 21 * * * 22 Section 2. R.S. 40:39 and 40(1) are hereby repealed. 23 Section 3. This Act shall become effective upon signature by the governor or, if not 24 signed by the governor, upon expiration of the time for bills to become law without signature 25 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 26 vetoed by the governor and subsequently approved by the legislature, this Act shall become 27 effective on the day following such approval.
