1	AN ACT
2 To amend and reenact R.S. 40:39.1(A)(1) and (B)(1) and 46(C), relative to vital records; to
3 provide for the purchase of the short-form birth certificate; to provide for an effective
4 date; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 40:39.1(A)(1) and (B)(1) and 46(C) are hereby amended and
7 reenacted to read as follows:
8 §39.1. Certified copies of birth certificates and death certificates; clerks of district
9	courts and the Second City Court of the city of New Orleans; Vital
10	Records Conversion Fund
11	A. The state registrar of vital records shall promulgate rules to implement the
12 issuance of certified copies of birth certificates and death certificates through the
13 office of the clerk of district court in each parish and the office of clerk of the Second
14 City Court of the city of New Orleans. Such rules shall apply only to issuance of
15 those birth and death records that are available for electronic issuance from the Vital
16 Records Registry birth and death databases and shall include access to the following
17 items:

1	(1) Automated access, retrieval, and production of short-form birth
2 certificates, long-form birth certificates, and death certificates by the clerks of district
3 courts and the clerk of the Second City Court of the city of New Orleans using the
4 data network available to the secretary of state.

6	B.(1) The clerk of district court in each parish and the clerk of the Second
7 City Court of the city of New Orleans may issue certified copies of short-form birth
8 certificate cards and long-form birth certificates and death certificates in accordance
9 with rules promulgated pursuant to Subsection A of this Section. In addition to fees
10 collected for issuance of a birth record or death certificate as provided in R.S. 40:40,
11 the clerk of court shall collect a fee of five dollars for a short-form birth certificate
12 and nine dollars for a long-form birth certificate or a death certificate.  A short-form
13 birth certificate card may only be purchased by an individual who also
14 purchases a long-form birth certificate in the same transaction.

16 §46. New certificate of birth when judgment of filiation is obtained

18	C. The new certificate of birth shall be signed by the child's father prior to its
19 recordation in the vital records registry and only after such signing and recordation
20 may certified copies or short-form birth certification cards be issued as in the case
21 of all other birth records. A short-form birth certificate card may only be
22 purchased by an individual who also purchases a long-form birth certificate in
23 the same transaction.

25 Section 2. This Act shall become effective upon signature by the governor or, if not
26 signed by the governor, upon expiration of the time for bills to become law without signature
27 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
28 vetoed by the governor and subsequently approved by the legislature, this Act shall become
29 effective on the day following such approval.

Proposed law retains present law and provides that a short-form birth certificate card may
only be purchased by an individual who also purchases a long-form birth certificate in the
