SENATE BILL NO. 186

1	AN ACT
2 To amend and reenact R.S. 56:799.2, 799.3(A)(4) and (D), the introductory paragraph of
3 799.5, and 799.6, and to repeal R.S. 56:799.4, relative to the White Lake Property
4 Advisory Board; to discontinue the board; to remove references to the board; and to
5 provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 56:799.2, 799.3(A)(4) and (D), the introductory paragraph of 799.5,
8 and 799.6 are hereby amended and reenacted to read as follows: 
9 §799.2. Definitions
10	As used in this Subpart, the following terms shall have the following
11 meanings:
12	(1) "Act of donation" means the "Act of Donation by BP America Production
13 Company to the State of Louisiana," dated July 8, 2002, and recorded July 11, 2002,
14 in the conveyance records of Vermilion Parish, bearing entry number 20208337 in
15 which the property in and around White Lake, located in Vermilion Parish, was
16 donated to the state.
17	(2) "Board" means the White Lake Property Advisory Board.

1	(3)(2) "Commission" means the Louisiana Wildlife and Fisheries
2 Commission.
3	(4)(3) "Department" means the Department of Wildlife and Fisheries.
4	(5)(4) "Fund" means the White Lake Property Fund.
5	(6)(5) "White Lake Property" means the properties owned by the state in and
6 around White Lake, located in Vermilion Parish which were donated to the state in
7 "Act of Donation by BP America Production Company to the State of Louisiana,"
8 dated July 8, 2002, and recorded July 11, 2002, in the conveyance records of
9 Vermilion Parish, bearing entry number 20208337.
10 §799.3. White Lake Property Fund
11	A. Effective January 1, 2005, there shall be established in the state treasury,
12 as a special fund within the Louisiana Wildlife and Fisheries Conservation Fund, the
13 White Lake Property Fund, hereinafter referred to as the "fund." After allocation of
14 money to the Bond Security and Redemption Fund as provided in Article VII,
15 Section 9(B) of the Constitution of Louisiana, the treasurer shall deposit in and credit
16 to the fund all of the following:

18	(4) All donations of private funds or public contributions made to the state,
19 commission, or department, or board for the conservation, administration, control,
20 management, development, or operation of the White Lake Property or the activities
21 conducted thereon.

23	D. The monies in the fund shall be appropriated only for the purposes set
24 forth in Subsection C of this Section. The legislature shall make no appropriation
25 from the fund which is inconsistent with the recommendations of the White Lake
26 Property Advisory Board.

28 §799.5. Commission duties and responsibilities
29	In addition to duties, responsibilities, and powers provided by the constitution

1 and statutory law and consistent with the recommendations of the board, the
2 commission:

4 §799.6. Department duties and responsibilities; powers
5	A. In addition to duties, responsibilities, and powers otherwise provided by
6 law and consistent with the recommendations of the board, the department shall
7 administer, control, and manage the White Lake Property.
8	B. Subject to recommendations by the board, the The department may enter
9 into cooperative endeavor agreements to fulfill its duties and responsibilities under
10 this Subpart. Each such agreement shall be subject to review by the Joint Legislative
11 Committee on the Budget.
12 Section 2.  R.S. 56:799.4 is hereby repealed.
