SENATE BILL NO. 189

PHARMACISTS.  Provides for pharmacist dispensing exceptions. (gov sig)
1	AN ACT
2 To amend and reenact R.S. 40:978(E)(3), relative to prescription drugs; to provide for an
3 exception from pharmacist dispensing limits on certain drugs; to provide for an
4 effective date; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 40:978(E)(3) is hereby amended and reenacted to read as follows:
7 ยง978. Prescriptions

11	(3) The provisions of this Subsection shall not apply if:
12	(a) the The prescription monitoring information from the state of the
13 prescriber may be viewed by the dispensing pharmacist. ; or
14	(b) The prescriber includes on the prescription a diagnosis of cancer or
15 terminal illness.

17 Section 2.  This Act shall become effective upon signature by the governor or, if not

1 signed by the governor, upon expiration of the time for bills to become law without signature
2 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
3 vetoed by the governor and subsequently approved by the legislature, this Act shall become
4 effective on the day following such approval.

Present law provides that the only exception to dispensing restrictions imposed by present
law is if the prescription monitoring information from the state of the prescriber may be
viewed by the dispensing pharmacist. Proposed law provides that an additional exception
will be if the prescriber includes on the prescription that it is for a patient with a diagnosis
of cancer or terminal illness.
Effective upon signature of the governor or upon lapse of time for gubernatorial action.
