SENATE BILL NO. 221

WILLS/TESTAMENTS.  Provides for separate writing identifying bequest of corporeal
movable property. (8/1/16)
1	AN ACT
2 To enact R.S. 9:2451, relative to separate writings identifying bequests of corporeal movable
3 property; to provide certain terms, conditions, procedures, requirements, and effects;
4 and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 9:2451 is hereby enacted to read as follows: 
7 ยง2451.  Separate writing identifying bequests of corporeal movable property
8	A. A written statement or list referred to in the decedent's testament or
9 any codicil thereto shall bequeath items of corporeal movable property other
10 than vehicles, money, securities, evidence of indebtedness, or property used in
11 a trade or business, not otherwise specifically bequeathed in the testament or
12 codicil.
13	B. To be admissible under this Section as evidence of an intended
14 bequest, the writing shall be signed by the decedent and shall describe the items
15 and the bequests with reasonable certainty. The writing may be prepared before
16 or after the execution of the testament or codicil, may be altered by the decedent
17 after its preparation, and may have no significance apart from its effect upon

1 the bequests made by testament or codicil.
2	C. If more than one otherwise effective writing exists, then, to the extent
3 of any conflict between or among the writings, the provisions of the most recent
4 writing shall revoke the inconsistent provisions of each prior writing.

Proposed law allows items of corporeal movable property other than vehicles, money,
securities, evidence of indebtedness, or property used in a trade or business, not otherwise
specifically bequeathed in the testament or codicil, to be bequeathed via a written statement
or list referred to in the decedent's testament or any codicil thereto. 
Effective August 1, 2016.
