SENATE BILL NO. 222

PUBLIC RECORDS.  Provides that certain records in the custody of the Louisiana State
Licensing Board for Contractors are exempt from the Public Records Law. (8/1/16)
1	AN ACT
2 To enact R.S. 44:4(51), relative to public records; to provide for the application of the public
3 records law; to provide exceptions from the public records law for certain security
4 issues; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 44:4(51) is hereby enacted to read as follows: 
7 ยง4. Applicability
8	This Chapter shall not apply:

10	(51) To any records, writings, accounts, letters, exhibits, pictures,
11 drawings, charts, photographs, or copies of memoranda thereof, in any reports
12 of examinations or evaluations or any other information or data, test questions,
13 or test answers in the custody of the Louisiana State Licensing Board of
14 Contractors concerning the fitness of any person or entity to receive, or
15 continue to hold a contractor's license. However, any final determination made
16 by the board and any legal grounds upon which such action is based, relative to
17 the fitness of a person or entity to receive or continue to hold a license shall be

Present law provides for the public records law and exceptions to the law.
Proposed law adds an exception for any records, writings, accounts, letters, exhibits,
pictures, drawings, charts, photographs, or copies of memoranda thereof, in any reports of
examinations or evaluations or any other information or data, test questions, or test answers
in the custody of the Louisiana State Licensing Board of Contractors concerning the fitness
or any person or entity to receive, or continue to hold a contractor's license. 
Proposed law also provides that once a final determination has been made concerning the
fitness of the contractor, the resources used to make the determination will become public
record. 
Effective August 1, 2016.
