SENATE BILL NO. 270

STUDENTS.  Provides relative to student data privacy. (gov sig)
1	AN ACT
2 To enact R.S. 17:3914(L), relative to student information; to require the Department of
3 Education to provide public school systems with certain student information; to
4 provide for the confidentiality of such information; to provide for penalties; and to
5 provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 17:3914(L) is hereby enacted to read as follows: 
8 ยง3914. Student information; privacy; legislative intent; definitions; prohibitions;
9	parental access; penalties

11	L.(1) Notwithstanding any provision of this Part to the contrary, the
12 Department of Education shall provide each city, parish or other local public
13 school system with such information, including personally identifiable student
14 information, as the school system deems necessary to verify the enrollment and
15 residency status of each student who resides within the geographic boundaries
16 of the school system but who is enrolled in a public school outside of the
17 jurisdiction of the local public school system. The local public school system

1 shall keep such information strictly confidential and shall use the information
2 for no other purpose than verifying student enrollment and residency.
3	(2) Any person who knowingly and willfully fails to maintain the
4 confidentiality of such information shall be subject to the penalties provided in
5 Subsection G of this Section.
6 Section 2.  This Act shall become effective upon signature by the governor or, if not
7 signed by the governor, upon expiration of the time for bills to become law without signature
8 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
9 vetoed by the governor and subsequently approved by the legislature, this Act shall become
10 effective on the day following such approval.

Present law provides for the protection of personally identifiable student information.
Proposed law retains present law and additionally provides that the Dept. of Education shall
provide each local public school system with the information, including personally
identifiable information, the system deems necessary to verify the enrollment and residency
status of each student residing within the boundaries of the school system but who are
enrolled in a public school outside of the jurisdiction of the local school system. Requires
the local school system to keep such information confidential and limits the use of the
information to the purpose of verifying student enrollment and residency.
Present law provides for a penalty of not more than six months imprisonment or a fine of not
more than $10,000 for anyone who violates the provisions of present law.
Proposed law provides that this penalty shall apply to a local public school system that fails
to keep confidential the information provided to verify student enrollment and residency
pursuant to proposed law.
Effective upon signature of the governor or lapse of time for gubernatorial action.
