SENATE BILL NO. 270

1	AN ACT
2 To enact R.S. 17:3914(L), relative to student information; to provide for certain school
3 governing authorities to enter into a memorandum of understanding for the provision
4 of certain student information; to provide for the confidentiality of such information;
5 to provide for penalties; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 17:3914(L) is hereby enacted to read as follows: 
8 ยง3914. Student information; privacy; legislative intent; definitions; prohibitions;
9	parental access; penalties
10	*          *          *
11	L.(1)  Notwithstanding any provision of this Part to the contrary, a local
12 public school system and the governing authority of a Type 2 charter school that
13 enrolls students who reside within the geographic boundaries of the local school
14 system shall enter into a memorandum of understanding to exchange student
15 information necessary to verify student enrollment and residency status. The
16 local public school system and the charter school governing authority shall keep
17 such information strictly confidential and shall use the information for no other
18 purpose than verifying student enrollment and residency.
19	(2)  A memorandum of understanding entered into pursuant to the
20 provisions of this Subsection shall comply with all applicable state and federal
21 law, including the Family Educational Rights Privacy Act.
22	(3)  Any person who knowingly and willfully fails to maintain the
23 confidentiality of such information shall be subject to the penalties provided in
24 Subsection G of this Section.

1 Section 2.  This Act shall become effective upon signature by the governor or, if not
2 signed by the governor, upon expiration of the time for bills to become law without signature
3 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
4 vetoed by the governor and subsequently approved by the legislature, this Act shall become
5 effective on the day following such approval.
