RÉSUMÉ DIGEST ACT 480 (SB 270) 2016 Regular Session Boudreaux Prior law provided for the protection of personally identifiable student information. New law additionally provides that a local public school system and a Type 2 charter school that enrolls students who reside within the geographic boundaries of such system shall enter into a memorandum of understanding (MOU) to exchange information necessary to verify student enrollment and residency status. Requires the system and school to keep this information confidential and to use it only for the purpose of verifying student enrollment and residency. Requires that the MOU comply with all applicable state and federal prior law, including the Family Educational Rights Privacy Act (commonly known as "FERPA"). Prior law provided for a penalty of not more than six months imprisonment or a fine of not more than $10,000 for violators. New law applies penalty to any person who knowingly and willfully fails to maintain the confidentiality of the information exchanged pursuant to new law.
