SLS 16RS-513 ENGROSSED 2016 Regular Session SENATE BILL NO. 325 BY SENATOR CLAITOR FUNDS/FUNDING. Makes changes to Judicial Building Fund as it relates to juvenile court matters. (7/1/16) 1 AN ACT 2 To amend and reenact R.S. 13:992.1(A) and (C)(4), relative to the Judicial Building Fund; 3 to provide for the application of certain court costs and service charges in the 4 Nineteenth Judicial District; to provide for an effective date; and to provide for 5 related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 13:992.1(A) and (C)(4) are hereby amended and reenacted to read as 8 follows: 9 ยง992.1. Judicial building fund 10 A. The Nineteenth Judicial District Court and the clerk of court of the 11 Nineteenth Judicial District are hereby authorized to impose the following additional 12 costs of court and service charges provided for in Subsection B of this Section in all 13 cases over which the court has jurisdiction, until the bonded indebtedness provided 14 for in Subsection C of this Section is paid. The costs and charges provided in 15 Subsection B of this Section shall not apply to cases involving juvenile and family 16 matters. The costs and charges may be up to and include the maximum amount set 17 forth and shall be imposed on order of the judges en banc. SB NO. 325 SLS 16RS-513 ENGROSSED 1 shall be paid to the clerk of court when the filing is made. 2 * * * 3 C. 4 * * * 5 (4) The monies generated pursuant to this Section shall be forwarded by the 6 clerk of court and sheriff to the fiscal agent bank chosen by the commission to be 7 held in the courthouse construction fund. Any funds currently on deposit to the 8 separate account of the judicial expense fund from the costs and charges authorized 9 by this Section shall be transferred at the discretion of the commission to the 10 courthouse construction fund held by the commission's fiscal agent. These monies 11 deposited to the courthouse construction fund shall be dedicated to the design, 12 planning, feasibility, acquisition, construction, equipping, operating, and maintaining 13 a new facility to house the Nineteenth Judicial District Court, the Family Court of 14 East Baton Rouge Parish, the Juvenile Court, the offices of the clerk of court for 15 the Nineteenth Judicial District, and such other ancillary agencies as may be 16 necessary. No monies generated pursuant to this Section shall be used for payment 17 of any bonded indebtedness involving site acquisition or construction of a new 18 facility unless approved by the Joint Legislative Committee on the Budget and the 19 State Bond Commission. 20 * * * 21 Section 2. This Act shall become effective on July 1, 2016; if vetoed by the governor 22 and subsequently approved by the legislature, this Act shall become effective on July 1, 23 2016, or on the day following such approval by the legislature, whichever is later. Present law provides that the monies generated by such costs and fees be forwarded by the clerk of court and sheriff to the fiscal agent bank chosen by the commission to be held in the courthouse construction fund. Also delineates the courts which will be housed in the new facility. Proposed law retains present law and adds the Juvenile Court to the list. Effective July 1, 2016.
