SENATE BILL NO. 35

INSURANCE POLICIES.  Requires insurance for persons handling explosives. (8/1/16)
1	AN ACT
2 To enact R.S. 40:1472.3(F), relative to licensing a manufacturer, dealer-distributor, user,
3 blaster, or handler of explosives; to provide for the requirement of liability insurance
4 as a condition for obtaining a license; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 40:1472.3(F) is hereby enacted to read as follows: 
7 ยง1472.3.  License; manufacturer, dealer-distributor, user, blaster, or handler of
8	explosives

10	F.  No license shall be issued by the deputy secretary pursuant to an
11 application therefor unless the applicant provides proof of liability insurance.
12 The liability insurance shall be in an amount not less than fifty million dollars
13 and shall provide coverage for damage caused by blast waves, blast wind, fire,
14 fragmentation, secondary fragmentation, shockwaves and stress waves which
15 result from the handling, movement, use, manipulation, or other action causing
16 the detonation of explosives by the applicant or an employee or agent of the
17 applicant.

Present law provides for the requirements of a manufacturer, dealer-distributor, user, blaster,
or handler of explosives to obtain a state-issued license.
Proposed law retains present law and adds the requirement of proof of a $50 million liability
insurance policy to cover damage caused by blast waves, blast wind, fire, fragmentation,
secondary fragmentation, shockwaves and stress waves as a condition of issuance of a
license.
