SENATE BILL NO. 381

LOCAL AGENCIES.  Provides for appointment of ex officio notaries for the Causeway
Police Department. (gov sig)
1	AN ACT
2 To enact R.S. 35:415, relative to ex officio notaries; to provide for the appointment of ex
3 officio notaries for the Causeway Police Department; to provide for the exercise of
4 authority; to provide for the authority of the chief of police of the department to
5 suspend or terminate the appointment; and to provide for related matters.
6	Notice of intention to introduce this Act has been published.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 35:415 is hereby enacted to read as follows:
9 ยง415.  Ex officio notaries for the Causeway Police Department
10	A.  Notwithstanding any provisions of the law relative to qualifications
11 for and limitations on the number of notaries public, the chief of police of the
12 Causeway Police Department, which employs peace officers who are certified
13 pursuant to the Peace Officer Standards and Training Law and are duly
14 authorized with the powers of arrest, may designate such officers in his office
15 as ex officio notaries public.
16	B.  Each officer appointed as an ex officio notary public may exercise,
17 within the jurisdictional limits of the Causeway Police Department, the

1 functions of a notary public only to administer oaths and to execute affidavits,
2 acknowledgments, traffic tickets, and other documents, all limited to matters
3 within the official functions of the department.
4	C.  Any acts performed by an ex officio notary public appointed
5 pursuant to this Section shall be performed only in the parishes in which the
6 Causeway Police Department has jurisdiction.
7	D.  All acts performed by an ex officio notary public appointed pursuant
8 to this Section shall be performed without charge or other compensation.
9	E.  The chief of police of the Causeway Police Department may suspend
10 or terminate an appointment made pursuant to this Section at any time and
11 separation from the employ of the department shall automatically terminate the
12 former employee's appointment as an ex officio notary public.
13 Section 2.  This Act shall become effective upon signature by the governor or, if not
14 signed by the governor, upon expiration of the time for bills to become law without signature
15 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
16 vetoed by the governor and subsequently approved by the legislature, this Act shall become
17 effective on the day following such approval.

Proposed law authorizes the chief of police of Causeway Police Department, which employs
peace officers who are POST certified and duly authorized with the powers of arrest, may
designate such officers in his office as ex officio notaries public. 
Proposed law provides that an ex officio notary appointed pursuant to proposed law shall
perform notary function without compensation and may exercise the functions of a notary
only within the jurisdiction of the police department and administer oaths related to the
official functions of the police department.
Proposed law provides that the appointment as an ex officio notary public automatically
terminates with a separation from employment. 
Effective upon signature of the governor or lapse of time for gubernatorial action.
