(8/1/16) 1 AN ACT 2 To amend and reenact R.S. 14:90.5(B), relative to the crime of unlawful playing of gaming 3 devices by persons under the age of twenty-one; to provide relative to the elements 4 of the crime; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 14:90.5(B) is hereby amended and reenacted to read as follows: 7 ยง90.5. Unlawful playing of gaming devices by persons under the age of twenty-one; 8 underage persons, penalty 9 * * * 10 B. Clement Jr. DIGEST SB 394 Engrossed 2016 Regular Session Carter Present law provides that it is unlawful for any person under 21 years of age to play casino games, gaming devices, or slot machines. Proposed law retains present law. Present law provides that a person under the age of 21 is not allowed to enter, or be permitted to enter, the designated gaming area of a riverboat, the official gaming establishment, or the designated slot machine gaming area of a pari-mutuel wagering facility that offers live horse racing licensed for operation and regulated under the applicable provisions of present law. Proposed law retains present law but makes clear that the prohibition of present law applies to the entire gaming area of an official gaming establishment, but not to the non-gaming areas of the establishment.
