DIGEST SB 399 Engrossed 2016 Regular Session Morrish Present law requires motor carriers to obtain a certificate of public convenience and necessity from the Louisiana Public Service Commission before they can operate as a common carrier, which requires an application, public hearing and a finding of public convenience and necessity by the commission. Present law provides that certain motor carriers are exempt from the requirement to prove public convenience and necessity prior to operating as a common carrier. Proposed law adds motor carriers of nonhazardous oil field waste, motor carriers of nonhazardous industrial solid waste, and motor carriers of hazardous waste to the list of motor carriers that are exempt from the public convenience and necessity requirements. Effective upon signature of the governor or lapse of time for gubernatorial action. (Amends R.S. 45:164(C))
