SENATE BILL NO. 402

CRIME/PUNISHMENT.  Adds provisions regarding the unlawful restraint of a dog. (8/1/16)
1	AN ACT
2 To amend and reenact R.S. 14:102.26(B), relative to domesticated animals; to provide
3 relative to the unlawful restraining of dogs; to provide regarding date and time
4 applicability; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 14:102.26(B) is hereby amended and reenacted to read as follows:
7 ยง102.26. Unlawful restraint of a dog; definitions; penalties

9	B.(1) It shall be unlawful to tie, tether, or restrain any animal in a manner that
10 is inhumane, cruel, or detrimental to its welfare.
11	(2) Except as provided in Subsection C of this Section, the provisions of
12 the Subsection shall apply on all days at all time in all areas of the state,
13 including during the days or times that a hurricane, tropical storm, tornado, or
14 flash flood warning has been issued for a particular geographic area of the state
15 by the National Weather Service.

Present law provides that it shall be unlawful to tie, tether, or restrain any animal in a manner
that is inhumane, cruel, or detrimental to its welfare. Provides certain exceptions.
Proposed law retains present law and provides that there shall be no exception to present law
during times when a hurricane, tropical storm, tornado, or flash flood warning has been
issued for the jurisdiction by the National Weather Service.
Effective August 1, 2016.
