(gov sig) 1 AN ACT 2 To provide relative to parishwide solid waste disposal districts; to provide for the powers 3 and duties of the district including the power to tax and to dedicate and rededicate 4 tax proceeds; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. Definitions. As used in this Act, "district" means a parishwide solid waste 7 disposal district created by an Act of the legislature and designated as a Solid Waste 8 Disposal District which is situated in a parish governed by a home rule charter and with a 9 population of between twenty-five thousand and fifty thousand persons according to the 10 latest federal decennial census. 11 Section 2. Powers and duties. The governing authority of a district, in addition to 12 the other powers and duties provided by law, shall have the power and duty to provide for 13 road maintenance and construction within the district. 14 Section 3. Rededication of tax proceeds. The district, through its governing 15 authority, shall have the power to redirect the proceeds of a tax levied, collected, and used 16 as authorized according to law provided that the district shall not propose to redirect the tax 17 proceeds until the parish governing authority has approved the calling of an election for that Page 1 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. SB NO. 459 SLS 16RS-1053 ORIGINAL 1 purpose, the district has obtained the consent and approval of the State Bond Commission 2 pursuant to R.S. 39:1410.61, and the qualified electors of the district have approved the 3 proposition at an election called for that purpose, all according to law. 4 Section 4. This Act shall become effective upon signature by the governor or, if not 5 signed by the governor, upon expiration of the time for bills to become law without signature 6 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 7 vetoed by the governor and subsequently approved by the legislature, this Act shall become 8 effective on the day following such approval. Provides that the governing authority of a district, in addition to the other powers and duties provided by law, shall have the power and duty to provide for road maintenance and construction within the district. Provides that the district, through its governing authority, may redirect the proceeds of a tax levied, collected, and used by the district as authorized according to law, if the parish governing authority approves the calling of an election for that purpose, the district obtains the consent and approval of the State Bond Commission pursuant to R.S. 39:1410.61, and the qualified electors of the district approve the proposition at an election called for that purpose, all according to law.
