ALCOHOLIC BEVERAGES.  Prohibits establishments that sell alcoholic beverages from
employing persons under twenty-one years of age for certain purposes. (8/1/16)
1	AN ACT
2 To amend and reenact R.S. 26:90(E) and 286(E), relative to holders of alcohol retail dealer's
3 permits for beverages of high alcoholic content; relative to holders of alcohol retail
4 dealer's permits for beverages of low alcoholic content; to provide for live
5 entertainment; to provide for age restrictions; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 26:90(E) and 286(E) are hereby amended and reenacted to read as
8 follows: 
9 §90. Acts prohibited on licensed premises; suspension or revocation of permits

11	E. Subject to the provisions of Subsection D of this Section, entertainers
12 whose breasts or buttocks are exposed to view shall perform only upon a stage at
13 least eighteen inches above the immediate floor level and removed at least three feet
14 from the nearest patron and shall be twenty-one years of age or older.

1	E. Subject to the provisions of Subparagraph (b)(i) of Subsection D of this
2 Section, entertainers whose breasts or buttocks are exposed to view shall perform
3 only upon a stage at least eighteen inches above the immediate floor level and

Present law prohibits the holder of a retail dealer's permit for beverages of high and low
alcoholic content and his agent, associate, employee, representative or servant to do or
permit certain acts to be done on or about the licensed premises.
Present law permits live entertainment on a licensed premise, except no holder of a permit
for beverages of high alcoholic content or low alcoholic content shall allow any person to
perform acts or acts which simulate:
(1)Sexual intercourse, masturbation, sodomy, bestiality, oral copulation, flagellation,
or any sexual acts which are prohibited by law.
(2)The touching, caressing, or fondling of the breast, buttocks, anus, or genitals.
(3)The displaying of the pubic hair, anus, vulva, genitals, or nipple of the female breast.
Present law provides that entertainers whose breasts or buttocks are exposed to view shall
perform only on a stage at least 18 inches above the floor level and at least three feet
removed from the nearest patron.
Proposed law retains all restrictions and requirements in present law and requires that
entertainers who perform with exposed breasts or buttocks be age 21 or older.
Effective August 1, 2016.
