2016 Regular Session ENROLLED SENATE BILL NO. 477(Substitute of Senate Bill No. 342 by Senator Boudreaux) BY SENATORS BOUDREAUX, APPEL, BISHOP, MILKOVICH, MORRISH, WALSWORTH AND WHITE AND REPRESENTATIVES HALL AND PRICE 1 AN ACT 2 To amend and reenact R.S. 17:3902(B)(5) and 3997(D)(2), relative to the evaluation of 3 public school teachers and administrators; to provide relative to the use of 4 value-added data in such evaluations; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 17:3902(B)(5) and 3997(D)(2) are hereby amended and reenacted to 7 read as follows: 8 §3902. Evaluation program; process 9 * * * 10 B. The elements of evaluation and standards for effectiveness shall be defined 11 by the board pursuant to rules and regulations promulgated for such purpose. Such 12 rules and regulations shall require that, at a minimum, local evaluation plans contain 13 the following elements: 14 * * * 15 (5) Measure of effectiveness. Fifty percent of such evaluations shall be based 16 on evidence of growth in student achievement using a value-added assessment model 17 as determined by the board for grade levels and subjects for which value-added data 18 is available. Data derived from a value-added assessment model, as determined 19 by the state board, shall be a factor in determining evidence of student growth 20 for grade levels and subjects for which value-added data is available and shall 21 comprise thirty-five percent of the overall evaluation. The model shall take into account important student factors, including but 2 not limited to special education, eligibility for free or reduced price meals, student 3 attendance, and student discipline. However, neither the value-added model nor the 4 measures of student growth for grade levels and subjects for which value-added data 5 are not available shall, in any given year, include a test score or data of a student who 6 has ten or more unexcused absences in any school semester in that year. The state 7 board shall develop and adopt a policy to invalidate such student growth data for any 8 teacher for any school year in which there is a natural disaster or any other 9 unexpected event that results in the temporary closure of the school. 10 * * * 11 §3997. This Act shall become effective upon signature by the governor or, if not 2 signed by the governor, upon expiration of the time for bills to become law without signature 3 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 4 vetoed by the governor and subsequently approved by the legislature, this Act shall become 5 effective on the day following such approval.
