SENATE BILL NO. 80

POSTSECONDARY ED.  Constitutional amendment to authorize the postsecondary
education management boards to establish tuition and fee amounts charged by institutions
under their supervision and management. (2/3-CA13sl(A))
1	A JOINT RESOLUTION
2 Proposing to add Article VIII, Section 7.2 of the Constitution of Louisiana, relative to
3 postsecondary education; to authorize certain postsecondary education management
4 boards to establish the tuition and mandatory fee amounts charged by the institutions
5 under their supervision and management; and to specify an election for submission
6 of the proposition to electors and provide a ballot proposition.
7 Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members
8 elected to each house concurring, that there shall be submitted to the electors of the state, for
9 their approval or rejection in the manner provided by law, a proposal to add Article VIII,
10 Section 7.2 of the Constitution of Louisiana, to read as follows:
11 ยง7.2. Postsecondary Education Management Boards; Tuition and Fee
12	Authority
13	Section 7.2. Notwithstanding the provisions of Article VII, Section
14 (2.1)(A), or any other provision of this constitution to the contrary, each
15 postsecondary education management board created by this Article shall have
16 the authority to establish the tuition and mandatory fee amounts charged by the
17 institutions under its supervision and management.

1 Section 2. Be it further resolved that this proposed amendment shall be submitted to
2 the electors of the state of Louisiana at the statewide election to be held on November 8,
3 2016, provided the Act which originated as Senate Bill No.79 of this 2016 Regular Session
4 of the Legislature is enacted and becomes effective.
5 Section 3. Be it further resolved that on the official ballot to be used at said election
6 there shall be printed a proposition, upon which the electors of the state shall be permitted
7 to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as
8 follows:
9	Do you support an amendment to authorize the postsecondary education
10	management boards to establish the tuition and mandatory fee amounts
11	charged by institutions under their supervision and management, without
12	legislative approval?
13	(Adds Article VIII, Section 7.2)

Present constitution (Art. VII, Sec. 2.1(A)) provides that any new fee or civil fine or increase
in an existing fee or civil fine imposed or assessed by the state or any board, department, or
agency of the state shall require the enactment of a law by a two-thirds vote of the elected
members of each house of the legislature.
Proposed constitutional amendment provides that, notwithstanding any constitutional
provision including Art. VII, Sec. 2.1(A) to the contrary, each constitutionally created
postsecondary education management board shall have the authority to establish the tuition
and fee amounts charged by institutions under its supervision and management, without
legislative approval.
Specifies submission of the amendment to the voters at the statewide election to be held on
November 8, 2016, provided Senate Bill No. 79 of the 2016 Regular Session is enacted and
becomes effective.
