SENATE CONCURRENT RESOL UTION NO. 100

LEGISLATIVE AGENCIES.  Requests Louisiana State Law Institute study the award of
child support for adult children with disabilities.
1	A CONCURRENT RESOL UTION
2 To urge and request the Louisiana State Law Institute to study the feasibility of revising
3 state law enacted in Act No. 379 of the 2015 Regular Session of the Legislature to
4 account for the financial burden of continuing child support awards for adult children
5 with disabilities places on elderly parents.
6 WHEREAS, during the 2015 Regular Session of the Legislature, the Legislature, in
7 Act No. 379, enacted certain changes to law relative to awards of child support for adult
8 children with disabilities; and
9 WHEREAS, such changes, in part, provide that an award of child support continues
10 or shall be set with respect to any unmarried child who, whether institutionalized or not, is
11 incapable of self-support and requires substantial care and personal supervision because of
12 an intellectual or physical disability that is manifested before the child attains the age of
13 majority; and
14 WHEREAS, such child support awards can continue indefinitely without taking into
15 account their financial burden on elderly parents.
16 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby
17 urge and request the Louisiana State Law Institute to study the feasibility of revising state
18 law enacted in Act No. 379 of the 2015 Regular Session of the Legislature to account for the

1 financial burden a continuing child support award for adult children with disabilities places
2 on elderly parents.
3 BE IT FURTHER RESOLVED that the Louisiana State Law Institute shall submit
4 a written report of its findings, together with any recommendations in the form of proposed
5 legislation, to the Legislature of Louisiana no later than February 1, 2017.
6 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
7 Director of the Louisiana State Law Institute.
