HOUSE BILL NO. 104

COURTS/DISTRICT:  Provides for an increase in certain fees and costs in the Twenty-Fifth
Judicial District Court
1	AN ACT
2To amend and reenact R.S. 13:996.66(A), relative to the judicial expense fund for the
3 Twenty-Fifth Judicial District Court; to increase certain fees and costs in civil and
4 criminal matters; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 13:996.66(A) is hereby amended and reenacted to read as follows: 
7 ยง996.66.  Judicial Expense Fund for Twenty-Fifth Judicial District
8	A.  In addition to all other fees or costs now or hereafter provided by law, the
9 clerk of court of the Twenty-Fifth Judicial District shall collect from every person
10 filing any type of civil suit or proceeding, and who is not otherwise exempted by law
11 from the payment of court costs, a sum to be determined by the judges of the district,
12 sitting en banc, which sum shall not exceed fifteen thirty-five dollars, subject to the
13 provisions of Code of Civil Procedure Article 5181 et seq.  In all criminal cases over
14 which the Twenty-Fifth Judicial District Court has jurisdiction, there shall be taxed
15 as costs against every defendant who is convicted after trial or after plea of guilty,
16 or who forfeits his bond, a sum likewise determined but which shall not exceed
17 fifteen thirty-five dollars, which shall be in addition to all other fines, costs, or
18 forfeitures lawfully imposed.

1 Section 2.  This Act shall become effective upon signature by the governor or, if not
2signed by the governor, upon expiration of the time for bills to become law without signature
3by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
4vetoed by the governor and subsequently approved by the legislature, this Act shall become
5effective on the day following such approval.

Proposed law retains present law but increases the sum from a maximum of $15 to a
maximum of $35.
Present law requires in all criminal cases in the 25

 JDC that every defendant, who is
convicted after trial or after a guilty plea or who forfeits his bond, be assessed costs not to
exceed $15 which shall be in addition to all other fines, costs, or forfeitures lawfully
imposed.
Proposed law retains present law but increases the costs from a maximum of $15 to a
maximum of $35.
Effective upon signature of governor or lapse of time for gubernatorial action.
