HOUSE BILL NO. 185

1	AN ACT
2 To enact Chapter 59-A of Title 37 of the Louisiana Revised Statutes of 1950, to be
3 comprised of R.S. 37:3661 through 3665, relative to military medical personnel; to
4 establish a pilot program to authorize retired military medical personnel to provide
5 certain healthcare services; to provide for definitions; to require progress reports and
6 final recommendations; to provide for a termination date of the pilot program; and
7 to provide for related matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1.  Chapter 59-A of Title 37 of the Louisiana Revised Statutes of 1950,
10 comprised of R.S. 37:3661 through 3665, is hereby enacted to read as follows: 
11	CHAPTER 59-A.  LOUISIANA MILITARY MEDICS
12	AND CORPSMEN PILOT PROGRAM
13 §3661.  Short title
14	This Chapter shall be known and may be cited as the "Louisiana Military
15 Medics and Corpsmen Pilot Program".
16 §3662.  Definitions
17	As used in this Chapter, the following words have the following meanings
18 unless the context clearly requires otherwise:
19	(1)  "Department" means the Louisiana Department of Veterans Affairs.
20	(2)  "Military medical personnel" means an individual who has recently
21 served as a medic in the United States Army, medical technician in the United States
22 Air Force, or corpsman in the United States Navy or the United States Coast Guard

1 and who was discharged or released from such service under conditions other than
2 dishonorable.
3	(3)  "Pilot program" means the Louisiana Military Medics and Corpsmen
4 Pilot Program established pursuant to this Chapter.
5 §3663.  Military medical personnel; pilot program
6	A.(1)  The department, in collaboration with each state agency or
7 professional or occupational licensing board or commission that regulates the
8 practice of a healthcare profession, shall establish a pilot program in which military
9 medical personnel may practice and perform certain delegated acts that constitute
10 healthcare services under the supervision of a physician or podiatrist who holds an
11 active, unrestricted license in Louisiana.  The activities  shall reflect the level of
12 training and experience of the military medical personnel.
13	(2)  The supervising physician or podiatrist shall retain responsibility for the
14 care of the patient.
15	B.  Any licensed physician or podiatrist, a professional corporation or
16 partnership of any licensee, any hospital, or any commercial enterprise having
17 medical facilities for its employees that are supervised by one or more physicians or
18 podiatrists may participate in the pilot program.
19	C.(1)  The department shall establish general requirements for participating
20 military medical personnel, licensees, and employers.
21	(2)  Each state agency or professional or occupational licensing board or
22 commission that participates in the pilot program may promulgate, in accordance
23 with the Administrative Procedure Act, any rules necessary for the implementation
24 of the program.
25 §3664.  Reporting requirements
26	The department shall report to the governor and to the House and Senate
27 committees on health and welfare no later than thirty days prior to the start of the
28 regular legislative session each year on the progress of the pilot program and shall
29 provide a written report of findings and recommendations upon termination of the
30 program.

1 §3665.  Termination date
2	Implementation of the Louisiana Military Medics and Corpsmen Pilot
3 Program shall terminate on December 31, 2020.
