CAPITAL OUTLAY:  Provides for the comprehensive Capital Outlay budget
1	AN ACT
2To provide with respect to the capital outlay budget and the capital outlay program for state
3 government, state institutions, and other public entities; to provide for the designation
4 of projects and improvements; to provide for the financing thereof making
5 appropriations from certain sources; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  The following sums or so much thereof as may be necessary are hereby
8appropriated out of any monies in the state treasury from the sources specified, from federal
9funds and self-generated revenues belonging to the state of Louisiana and/or collected by
10boards, commissions, departments, and agencies thereof, all for making capital outlay and
11for the purposes and in the amounts specified herein for the Fiscal Year commencing July
121, 2017, and ending June 30, 2018, subject to the conditions thereafter provided:
13 A project with funding payable from General Obligation Bonds Priority 1 indicates that
14the funding for the project includes the reauthorization of funding which was previously on
15a line of credit granted by the State Bond Commission in Fiscal Year 2016-2017.  As used
16in this Section, the term "general obligation bonds" means state general obligation bonds or
17other evidences of indebtedness payable from the Bond Security and Redemption Fund.  The
18amount set forth in this Section opposite each project, or so much thereof as may be
19necessary, is hereby appropriated and payable from the proceeds available from the sale of
20general obligation bonds, unless a different source of funding is indicated.  Where such a
21different source of funding is indicated, the corresponding amount set forth, or so much

1thereof as may be necessary, is hereby appropriated and payable from the source of funding
2indicated; provided, however, amounts appropriated and payable from federal funds may be
3encumbered or expended only to the extent such amounts shall have been committed or
4received.  Pursuant to the provisions of R.S. 39:82, funds for planning, acquisition,
5construction, and major repair projects appropriated by this Act may be retained until
6completion of the project, even if no bona fide liability exists on the last day of the fiscal
7year. 
8 This Act shall constitute the comprehensive state capital outlay budget for the 2017-
92018 Fiscal Year.  Projects set forth which are payable from the proceeds available from the
10sale of general obligation bonds shall have the priorities as indicated.  The Request for Line
11of Credit form used by the attorney general and Bond Counsel in evaluating Louisiana
12Constitutional, Internal Revenue Code, and applicable income tax regulations shall be filed
13with the commissioner of administration, State Bond Commission, and state attorney
14general.  No general obligation bonds shall be sold, nor cash lines of credit granted to fund
15any lower priority project prior to the sale of general obligation bonds or the granting of cash
16lines of credit to fund all higher priority projects (the "general rule"), except as hereinafter
17provided.  This prohibition against funding a lower priority project shall not apply upon a
18showing of an impossibility or impracticality either to proceed with all unfunded higher
19priority projects or to proceed with the funding of such projects or any part thereof through
20the issuance of general obligation bonds for any reason.  Such showing shall be stated in
21reasonable detail in a certificate or certificates signed by the state agency responsible for
22administering the funding, and filed with the commissioner of administration and the State
23Bond Commission (hereinafter referred to as "the Commission").  Upon a determination by
24the Commission that proceeding with such a project or the funding thereof through the
25issuance of general obligation bonds is impractical or impossible, the Commission may then
26proceed with the sale of general obligation bonds or the granting of cash lines of credit
27without regard to the priority of the unfunded projects determined to be impossible or
28impractical. 
29 Upon recommendation by the state agency responsible for administering the funding,
30if it is determined at any time that proceeding with the project or with the funding thereof

1is no longer impossible or impractical, the State Bond Commission may rescind the
2certificate of impossibility or impracticality and may proceed with the project or with the
3issuance of general obligation bonds or the granting of cash lines of credit to fund the
4project.  Alternatively, the Interim Emergency Board (hereinafter referred to as "the Board"),
5upon reviewing certificates as described above and determining that proceeding with such
6project or the funding thereof through the issuance of general obligation bonds is impossible
7or impractical, may designate a lower priority for such project.  The Board's determination
8and lower priority designation shall be submitted to the members of the legislature for their
9approval in accordance with the provisions of Chapter 3-B of Subtitle I of Title 39 of the
10Louisiana Revised Statutes of 1950.  In accordance with the provisions of Chapter 3-B of
11Subtitle I of Title 39 of the Louisiana Revised Statutes of 1950, whenever at the written
12request of the appropriate legislators and agency, the Board determines that an adjustment
13to a project description originally set forth in such capital budget adopted by the legislature
14for a current fiscal year is necessary to correct a mistake in a project description, clarify a
15description, change the scope of a description, or make any other adjustment the Board
16deems necessary to implement the purpose of the project, such adjustment shall become
17effective only upon the approval by majority vote of the elected members of each house of
18the legislature in the manner provided for in Chapter 3-B of Subtitle I of Title 39 of the
19Louisiana Revised Statutes of 1950. 
20 If such approval is granted, notification by the chair or secretary of the Board of the
21results of the balloting shall be transmitted to the State Bond Commission, which may then
22proceed with the sale of general obligation bonds or the granting of cash lines of credit for
23each change approved upon request of the commissioner of administration in accordance
24with the general rule. 
25 With respect to Priorities 1 through 5, a lower priority project may be moved to a
26higher priority only upon a showing of an emergency or other cause not reasonably
27anticipated by the legislature, which shall be stated in reasonable detail in a certificate signed
28by the head of the appropriate department, political subdivision, or agency and filed with the
29commissioner of administration and the Board.  Upon a determination by the Board that such
30project should be moved to a higher priority because of an emergency or other cause not

1reasonably anticipated by the legislature, the Board shall designate a higher priority to the
2project.  The matter then shall be submitted to and be subject to the same approval by the
3members of the legislature in the manner previously indicated in this Section.  If such
4approval is granted, notification by the chair or secretary of the board of the change of
5priority shall be transmitted to the State Bond Commission, which then upon request of the
6commissioner of administration, may proceed with the sale of general obligation bonds or
7the granting of cash lines of credit in accordance with the general rule.  As to projects within
8a priority, the State Bond Commission acting on requests submitted by the commissioner of
9administration shall determine when such project, or phases thereof, shall be funded.  In
10making such determination, the State Bond Commission shall consider the amount of
11proceeds of general obligation bonds to be made available in light of money and capital
12market conditions; the expenditure requirements of the project; the time required for
13architectural plans and drawings, public bidding, and site acquisition and preparation;
14availability of receipt of federal monies; litigation affecting the undertaking or completion
15of a project; federal tax laws and regulations regarding the sale of municipal bonds; and
16other items of a similar nature bearing upon the possibility or the necessity to commence a
17project or any particular phase thereof. 
18 Any other provision of this Act to the contrary notwithstanding, projects described in
19Priority 5 of this Act shall not be moved to a higher priority except upon one of the
20following conditions: (1) Funding is necessary to complete or additionally fund a project
21located elsewhere in the Capital Outlay Act.  Determination of such condition shall be made
22by the head of the appropriate department or agency by means of a certificate to that effect
23filed with the Interim Emergency Board, who shall, by mail ballot, request approval of such
24change and if approved by a majority of each house of the legislature it shall be funded, or
25(2) unless required by an emergency or other cause not reasonably anticipated by the
26legislature, to be in accordance with procedures set forth in this Section.  However, the State
27Bond Commission may authorize a non-cash line of credit for any project in Priority 5 which
28represents that portion of construction contracts which were let during a previous fiscal year,
29or construction contracts which will be let during the current fiscal year, but which will not
30require cash expenditures during the year.  Such non-cash lines of credit, when combined

1with previously sold bonds or with higher priority bonds or lines of credit, or with funds
2appropriated from other sources, will provide sufficient appropriated funds to award
3equipment or construction contracts.  Contracts shall not be awarded without approval of the
4division of administration.
5 Upon approval by the State Bond Commission, and subject to compliance with its
6policies and procedures and the procedures set forth herein, a line of credit providing for the
7use of funds in anticipation of the sale of general obligation bonds may be granted to the
8appropriate administering agency or department from the Comprehensive Capital Outlay
9Escrow Account, or if there is not a sufficient amount available in such account, from other
10available state cash in the state treasury, for capital improvement projects for which bond
11proceeds are appropriated by a current capital budget, prior to the actual issuance of bonds
12for such projects, unless the attorney general advises that an impediment exists to the valid
13issuance of the bonds on the date such line of credit is granted. 
14 All bonds that are to be repaid, in whole or in part, by revenues generated by the
15project shall be designated as "Reimbursement Bonds".  The State Bond Commission shall
16enter into such agreements as are necessary to provide that the agency or subdivision, whose
17project is reimbursable, shall pay the bond debt costs into the Bond Security and Redemption
18Fund.  Such costs may be paid annually or at the end of the term of the bonds issued as
19determined by the State Bond Commission. 
20 Priority 1 general obligation bond funding shall be limited to: 
21 (1)  Projects and amounts which were previously authorized by Act 16 of the 2016
22Second Extraordinary Session of the Legislature; and which were granted cash lines of credit
23by the State Bond Commission.  The bonds to fund these projects were not sold in Fiscal
24Year 2016-2017.
25 (2)  The reauthorization of the portion of the outstanding Fiscal Year 2016-2017
26Priority 5 Non-Cash Lines of Credit for projects which will require cash expenditures in
27Fiscal Year 2017-2018 and therefore must be converted to Cash Lines of Credit in Fiscal
28Year 2017-2018.

26projects approved pursuant to the Highway Priority Program, Airport Construction and
27Development Priority Program, Port Construction and Development Priority Program, and
28Statewide Flood Control Program for projects bid and awarded, authorized, or commenced
29during the fiscal year which do not require cash expenditures for the full contract or
30agreement amount.

8 Section 2.  The expenditure of funds appropriated in this Act, except appropriations
9made to nonprofit economic development corporations, shall be in conformity to all existing
10statutes relative to public bidding, contractual review, and R.S. 39:101 through 128 and any
11other statutes affecting the capital outlay program for state government, state institutions,
12and political entities.  No contract shall be awarded for any project prior to the granting of
13a line of credit or the sale of bonds by the State Bond Commission, determination by the
14state treasurer that cash funding is available in the Comprehensive Capital Outlay Escrow
15Account for the project, or delivery of revenue bonds whose issuance is authorized in
16Section 1 of this Act. 
17 Section 3.  Payment for projects specified in this Act must be made by warrant
18submitted to the division of administration, Department of Transportation and Development,
19the state treasurer or other administering agency as provided in Section 8, whichever is
20appropriate, only to the extent of funds required for immediate payment. Copies of invoices
21or other supporting documentation shall be submitted with warrants.  In the event that any
22equipment included in this Act, is procured pursuant to the provisions of the State Lease-
23Purchase Act, R.S. 39:1761 et seq., the amounts included in this Act for each such piece of
24equipment shall not be appropriated.  The provisions of R.S. 39:1771 which require
25equipment to be leased under the State Lease-Purchase Act to be included in the executive
26budget and approved by the legislature through inclusion in the General Appropriation Act
27shall be considered waived upon the inclusion of such equipment in this Act.  Projects
28contained in this Act may, at the direction of the division of administration and with the
29approval of the State Bond Commission, alternatively be funded through financing programs
30heretofore or hereafter provided by a public trust and public corporation duly organized
31pursuant to R.S. 9:2341 et seq., having for its beneficiary the state and the Louisiana Local
32Government Environmental Facilities and Community Development Authority, pursuant to
33R.S. 33:4548.1 et seq.

1 Section 4.  If at any time during the Fiscal Year 2017-2018, the governor should find,
2or the Joint Legislative Committee on the Budget or the commissioner of administration
3should report to the governor, that the receipts of the treasury are falling short or appear
4likely to fall short of the revenue estimates for the fiscal year and that a cash deficit is likely
5to be incurred, the governor shall take such steps as deemed necessary to prevent the
6occurrence of a cash deficit.  In the event that a capital outlay project funded in this Act falls
7under an agency which is abolished or for which funds are not appropriated in the 2017-2018
8General Appropriation Act, then the funds appropriated in this Act for such capital outlay
9projects shall not be expended unless deemed necessary by the governor to protect life or
10property.  In the event that legislation is enacted which transfers facilities or programs for
11which projects are funded in this Act, on behalf of one agency, institution, department, or
12management board to another agency, institution, department, or management board, then
13the projects in this Act shall be deemed transferred also.
14 Section 5.  All monies appropriated by this Act and any applicable funds of a prior
15capital outlay budget act adopted by the legislature shall be deposited by the state treasurer
16in the Comprehensive Capital Outlay Escrow Account, established by this Section, in the
17state treasury.  In accordance with R.S. 36:764, no later than sixty days following the end
18of each quarter, the state treasurer shall report to the Joint Legislative Committee on the
19Budget and the commissioner of administration, all funds contained in the Miscellaneous
20Fund of the Comprehensive Capital Outlay Escrow Account.  Notwithstanding any
21provisions contained herein or other law to the contrary, any original issue premium or
22accrued interest proceeds received pursuant to the sale of general obligation bonds shall
23remain on deposit to the credit of the Bond Security and Redemption Fund until such time
24as they may be utilized in accordance with U.S. Department of the Treasury Regulations
25promulgated pursuant to the Internal Revenue Code of 1986.  All such monies shall be
26administered according to the particular act pertaining to the fiscal year in which such
27monies were appropriated.  If it is determined by the director of the office of facility
28planning and control, division of administration, that the funds appropriated by this Act or
29any prior capital outlay budget act are not sufficient to complete the projects contained in
30any capital outlay budget act, through unavoidable deficiencies in appropriation, including

1administrative and legal requirements, the commissioner of administration, subject to
2approval of the Joint Legislative Committee on the Budget, may direct the use of interest
3earned from the investment of general obligation bond or note proceeds in the
4Comprehensive Capital Outlay Escrow Account, not to exceed an aggregate of five million
5dollars in any one fiscal year, for the purpose of completing the projects contained in any
6capital outlay budget act and such money shall be deemed appropriated in specific amounts
7necessary for such purpose.  All appropriations in this Act which are made as additions to
8funds for previously authorized projects shall be included, for accounting purposes, in the
9account of the previously authorized projects.  If it is determined by the director of the office
10of facility planning and control, division of administration, that it is cost effective and
11practical to combine individual appropriations, the commissioner of administration, subject
12to the approval of the Joint Legislative Committee on the Budget, may direct that two or
13more appropriations or parts thereof may be combined into a single project for accounting
14and audit purposes.  The commissioner of administration may direct that funding in the
15various statewide and/or multiple parish projects for improvements for state facilities may
16be transferred to any project, in this Act or any previous Capital Outlay Act, which require
17supplemental funding for improvements for state facilities which qualify for funding through
18the various statewide and/or multiple parish projects for improvements for state facilities. 
19The office of facility planning and control, division of administration is authorized to receive
20settlements and vendor rebates not in excess of $50,000 unless approved by the Joint
21Legislative Committee on the Budget, and to add those receipts to the funding for projects
22in this Act or any previous Capital Outlay Act for which project funds are received.  The
23office of facility planning and control, division of administration is authorized to receive
24insurance payments and are hereby authorized to immediately repair facilities that suffer
25insurance losses without those projects being included in the Act and shall report to the Joint
26Legislative Committee on the Budget any expenditures from insurance funds received
27pursuant to this section.  A portion, as determined by the commissioner of administration and
28not to exceed one percent (1%), of the funding for projects which qualify for the Percent for
29Art Program, may be transferred from the qualifying project budgets, to the Department of
30Culture, Recreation and Tourism for costs of acquiring art and administering the program.

1For all Percent for Art Program projects in this or any previous capital outlay, up to ten
2percent (10%) of the aforementioned one percent (1%) may be used for the costs of
3administering the projects.
4 Section 6.  Prior to March 1, 2018, the commissioner of administration shall submit
5to the Joint Legislative Committee on Capital Outlay a list of projects that are completed and
6the cash balances remaining in each project. 
7 Section 7.  The commissioner of administration, with the approval of the Joint
8Legislative Committee on the Budget, is authorized to supplement or substitute the
9appropriations specified in this or previous capital outlay acts with any federal or other funds
10which are or may become available and such funds shall be deemed appropriated in specific
11amounts necessary for the purposes of this Act.  Any funds received by the State Bond
12Commission as a result of a prepayment of reimbursement contracts as authorized by law
13and the policy and procedure for reimbursement contracts of the Department of Treasury,
14office of State Bond Commission, shall be deposited as set forth in such policy and
15procedure and shall be deemed available and appropriated in specific amounts necessary for
16the purposes of this Act pursuant to the procedure set forth in this section.
17 Section 8.  All of the funds herein appropriated, except for appropriations made to
18the Department of Military Affairs, the Legislature, the Louisiana Stadium and Exposition
19District, the Department of Economic Development, the Coastal Protection and Restoration
20Authority, the Division of Administration for Supplemental State Funds for Local
21Government Assistance Program, the Division of Administration for the Community Water
22Enrichment Program or the Department of Transportation and Development, shall be
23considered as having been appropriated directly to the Office of Facility Planning and
24Control, Division of Administration, and all projects herein authorized and funded shall be
25subject to the provisions of R.S. 39:101 through 128.  All of the funds appropriated in the
26Capital Outlay Act under the name of non-state entities shall be administered by the Office
27of Facility Planning and Control, Division of Administration, under cooperative endeavor
28agreements.  All cooperative endeavor agreements for non-state entities shall be prepared
29by the Office of Facility Planning and Control and the Commissioner of Administration is
30hereby authorized and directed to effectuate any necessary transfer of funds from the

1Department of Justice to the Office of Facility Planning and Control in order to accomplish
2this purpose.  However, all cooperative endeavor agreements between the Department of
3Transportation and Development and non-state entities entered into prior to the passage of
4this Act shall continue to be administered by the Department of Transportation and
5Development.  Cooperative endeavor agreements entered into pursuant to this Act, and
6approved by the Commissioner of Administration or his designee, or the Secretary of the
7Department of Transportation and Development for projects appropriated to or administered
8by the Department of Transportation and Development, shall not be required to be submitted
9to the Division of Administration, Office of Contractual Review.  For all projects in the
10Capital Outlay Act or a previous Capital Outlay Act which are appropriated to the Office of
11Facility Planning and Control, Division of Administration, including those administered by
12cooperative endeavor agreements, up to six percent of each line-item may be used for costs
13of administering the projects.  For all projects in Capital Outlay Act or a previous Capital
14Outlay Act appropriated to the Department of Transportation and Development, up to six
15percent of each line-item may be used for costs of administering the projects, or for field
16engineering/construction supervision.  Line-item general obligation bond projects
17appropriated to the Department of Transportation and Development in the Capital Outlay
18Act or a previous Capital Outlay Act shall be authorized to draw Transportation Trust Funds
19from the Highway Program appropriation, for supplemental funding on overruns in excess
20of the original estimated project cost as determined by the Department of Transportation and
21Development, provided however that said projects are in the state or federal highway system
22and in the priority program, and the overrun is less than $50,000.  Any such overrun of
23$50,000 or more must be approved by the Joint Legislative Committee on the Budget. 
24Furthermore, all ports, levee districts and other non-state entities must have a fully executed
25cooperative endeavor agreement, from the Office of Facility Planning and Control,
26Department of Transportation and Development, or the State Treasurer, whichever is
27appropriate, before entering into any contracts which obligate state funding and must follow
28all laws pertaining to public bidding.  If a port, levee district or other non-state entity enters
29into a contract prior to receipt of funding, or prior to execution of a cooperative endeavor
30agreement, then payments under such contracts are prohibited from capital outlay

1appropriations, and are the sole responsibility of the port, levee district, or other non-state
2entity.  Notwithstanding the provisions of this Act, the Capital Outlay Act, or any previous
3capital outlay act, contracts may be entered into for the Atchafalaya Basin Protection and
4Enhancement Kemper Williams project in St. Mary Parish prior to a cooperative endeavor
5agreement being entered into with the state. Notwithstanding anything contained in this Act,
6the Capital Outlay Act, or any previous capital outlay act to the contrary or any other
7provision of law, contracts may be entered into for the Youngsville Sports Complex project
8in Lafayette Parish, prior to receipt of funding and prior to execution of the cooperative
9endeavor agreement and the state is authorized to financially participate in obligations
10created by such contracts.  Notwithstanding the provisions of R.S. 39:112(E)(2), the project
11for Independence, Independence Area Community Pavilion, Planning and Construction,
12shall be exempt from all local match requirements. Notwithstanding anything contained in
13this  Act or the Capital Outlay Act to the contrary or any other provision of law, the scope
14of the appropriations made in the Capital Outlay Act or any other Capital Outlay Act for the
15St. Mary Parish Plantation Pump Station Replacement project shall be deemed to include
16repair, equipment, rehabilitation and infrastructure improvements at the existing Plantation
17Pump Station.  Notwithstanding anything contained in this Act or the Capital Outlay Act to
18the contrary or any other provision of law, the scope of the appropriations made in this or
19any other Capital Outlay Act for the Louisiana 4-H Foundation, Youth Education
20Development Camp Windy Wood project, shall be deemed to include planning, construction,
21and acquisition.  Notwithstanding anything contained in this Act or the Capital Outlay Act
22to the contrary or any other provision of law, the scope of the appropriations made in the
23Capital Outlay Act or any other Capital Outlay Act for the Youngsville Parkway Road
24project shall be deemed to include waterline improvements and roadway lighting.
25Notwithstanding anything contained in this Act or the Capital Outlay Act to the contrary, or
26any other provision of law, the scope of the appropriations made in the Capital Outlay Act
27or any other Capital Outlay Act for the City of New Orleans, Eastern New Orleans Hospital
28and Medical Office Building, Real Estate Acquisition, Planning, Design, Construction,
29Renovation and Equipment project, the City of New Orleans  may make such capital outlay
30funds available to the Parish Hospital Service District of the Parish of Orleans District "A"

1in furtherance of the District's planning, design, acquisition, development, renovation,
2construction, equipment and operation of a hospital and medical office building in Eastern
3New Orleans. Notwithstanding anything contained in this Act or the Capital Outlay Act, or
4in any cooperative endeavor agreement between the Office of Facility Planning and Control
5and the City of New Orleans or the Hospital Service District to the contrary, the Hospital
6Service District may mortgage or otherwise encumber any and all land, real estate property,
7including buildings and equipment, and appurtenances acquired, in whole or part, with state
8capital outlay funds provided that bond counsel to the state opines that such mortgage shall
9not affect the tax-exempt status of the bonds to be issued by the state for the project.
10Notwithstanding anything in this Act or the Capital Outlay Act to the contrary, contracts
11may be entered into for the City of New Orleans, Eastern New Orleans Hospital and Medical
12Office Building, Real Estate Acquisition, Planning, Design, Construction, Renovation and
13Equipment project prior to receipt of funding and prior to execution of the cooperative
14endeavor agreement.  Notwithstanding anything contained in this Act or the Capital Outlay
15Act to the contrary or any other provision of law, the scope of the appropriations made in 
16the Capital Outlay Act or any other Capital Outlay Act for the Jefferson Parish Bonnabel
17Canal Rehabilitation and Bank Stabilization (Veterans Boulevard to West Esplanade),
18Planning and Construction project shall be deemed to include steel sheet pile bulkhead,
19and/or bank excavation and reshaping, bridge replacement, property acquisition, demolition
20and improvements needed to stabilize the canal bank along the Bonnabel Drainage Canal in
21order to address canal bank failures between Veterans Boulevard and West Esplanade
22Avenue.  Notwithstanding anything contained in this Act or the Capital Outlay Act to the
23contrary or any other provision of law, the scope of the appropriations made in this or any
24other Capital Outlay Act for the New Orleans Norman Playground Basketball Gym,
25Planning and Construction project shall be deemed to include park enhancements for a
26walking track, basketball, football and baseball fields and a concession stand. 
27Notwithstanding anything contained in this Act or the Capital Outlay Act to the contrary or
28any other provision of law, the Parks Municipal Complex, Planning and Construction project
29shall include the purchase, construction or renovation of a new facility in St. Martin Parish. 
30Notwithstanding anything contained in this Act or the Capital Outlay Act to the contrary or

1any other provision of law, the Parish Road Improvements Project for Franklin Parish is
2exempt from the contract limit set forth in R.S. 38:2212.  Notwithstanding anything
3contained in this Act or the Capital Outlay Act to the contrary or any other Act or provision
4of law, the appropriations made for the Executive Department for facilities which promote
5economic development included in the Repair, Restoration, and Replacement for Hurricanes
6Katrina and Rita project, and the Department of Economic Development projects are for
7public purposes pursuant to the provisions of Article VII, Section 14 of the Constitution of
8Louisiana primarily for economic development, including the generation of tax revenues,
9creation of jobs, promotion of tourism, and creation of facilities for charitable, cultural,
10artistic, educational, social, civic, research, service, economic development activities, or
11provide facilities for professional golf events, pursuant to the terms of cooperative endeavor
12agreements, including leases and all expenditures of these appropriations and may be
13exempted, by the Commissioner of Administration, from all statutes relative to public
14bidding, contractual review and the provisions of R.S. 33:9029.2(D) and in lieu thereof be
15allowed to use alternative competitive contracting arrangements where the appropriate
16administering entity submits documentation to the Commissioner of Administration
17substantiating that it is in the best interest of the citizens of the state, due to economic and/or
18operational benefits, and the necessity to complete the projects in a timely manner; and, the
19appropriate administering entity shall have the authority to directly appoint the design
20professional from a list of a minimum of three design firms or joint ventures with the
21appropriate specialized facility design experience submitted to and acceptable to the
22Commissioner of Administration and shall be exempt from other state requirements for
23selection of designers, and may include expenditures for computers, fixtures, furniture, and
24other equipment as such is deemed to be capital outlay in nature, and unless the
25Commissioner of Administration is advised by bond counsel to the State that such may
26violate federal tax law, may be used to reimburse any expenditure made prior to the granting
27of a line of credit or the sale of bonds by the State Bond Commission, determination by the
28State Treasurer that cash funding has been deposited in the Comprehensive Capital Outlay
29Escrow Account for the project or the execution of a cooperative endeavor agreement from
30the Office of Facility Planning and Control, and may be used to acquire land or real property,

1the title to which is held in the name of an entity exempt from taxation under the provisions
2of 26 U.S.C. 501(c)(3).  Notwithstanding anything contained in this Act or the Capital
3Outlay Act to the contrary or any other provision of law, all of the funds herein appropriated
4to the Department of Economic Development in connection with the Capital Improvements
5Project to Meet Economic Development Commitments for which the Department of
6Economic Development utilizes a cooperative endeavor agreement to further economic
7development as permitted under Article VII, Section 14 of the Louisiana Constitution,
8including the generation of tax revenues and creation of jobs, shall be considered as having
9been appropriated to the Department of Economic Development, may be used to reimburse
10any expenditure made prior to the granting of a line of credit and made prior to the execution
11of a cooperative endeavor agreement and shall be administered solely by the Department of
12Economic Development pursuant to, in compliance with, and on the terms contained in such
13cooperative endeavor agreements. Notwithstanding any provision of law to the contrary, the
14Commissioner of Administration is hereby authorized to take such actions as are necessary,
15including using such funds as may be available including those appropriated and available
16under this Act or the Capital Outlay Act for professional sports facilities through the
17Louisiana Stadium and Exposition District and that are otherwise available, executing on
18behalf of the State such documents as are necessary in order to terminate the ground lease
19between the State and the PGA and thereby acquiring all leasehold improvements for the
20State, extending the management agreement between the State and the PGA, and extending
21the sponsorship and presence of the Zurich Classic in the Greater New Orleans area. 
22Notwithstanding anything contained in this Act, or the Capital Outlay Act, or any other
23capital outlay act, contracts may be entered into for the Port of South Louisiana, Globalplex
24Rail Siding; Globalplex Terminal Building #71 Upgrade, Planning and Construction and/or
25Administration Building (also known as the Business Development Center) projects prior
26to receipt of funding and prior to execution of a cooperative endeavor agreement. 
27Notwithstanding anything in this Act, the Capital Outlay Act, any previous capital outlay act,
28or other provision of law to the contrary, the scope of the appropriation for the Port of South
29Louisiana Globalplex Terminal Building #71 Upgrade project shall be deemed to also
30include similar upgrades for other Globalplex Terminal Buildings.  Notwithstanding

1anything in this Act, any previous capital outlay act, or other provision of law to the
2contrary, monies appropriated herein for the Port of South Louisiana Globalplex Terminal
3Building #71 and Other Globalplex Terminal Building Upgrades, Planning and Construction
4may be expended for design fees related to the conveyor system and ancillary equipment that
5exceed the customary ten percent limitation on design fee costs.  Notwithstanding anything
6in this Act or the Capital Outlay Act to the contrary or any other provision of law, contracts
7may be entered into for the Greater Baton Rouge Port Commission Inland Rivers Marine
8Terminal Dock and Access Roadway Construction Project, Planning and Construction
9Project prior to receipt of funding and prior to the execution of a cooperative endeavor
10agreement. Notwithstanding anything in this Act to the contrary or any other provision of
11law, monies appropriated herein for the Juban Road (LA1026) Widening (I-12 to US 190)
12project may be expended for the installation of sewer lines along the roadway and pursuant
13to a cooperative endeavor agreement between the Department of Transportation and
14Development and Livingston Parish, funds may be provided to Livingston Parish for that
15purpose. Notwithstanding anything contained in this act to the contrary or any other
16provision of law, the appropriations made for the Louisiana Stadium and Exposition District
17shall be appropriated directly to the Louisiana Stadium and Exposition District, and are
18public purposes pursuant to the provisions of Article VII, Section 14 of the Constitution of
19Louisiana primarily for economic development, including the generation of tax revenue,
20creation of jobs, and the generation of tourism, and may be used to reimburse any
21expenditure made prior to the granting of a line of credit or the sale of bonds by the State
22Bond Commission, determination by the State Treasurer that cash funding has been
23deposited in the Comprehensive Capital Outlay Escrow Account for the project. The
24Louisiana Stadium and Exposition District may apply up to $10,000,000 to reimburse the
25New Orleans Pelicans NBA, LLC for costs incurred in constructing a new training facility
26as contemplated by the Amended and Restated Arena Use Agreement dated July, 1 2015;
27but, otherwise, contracts for projects funded through this appropriation shall be awarded
28utilizing the public bid and contractual review process set forth in Chapter 10 of Title 38 and
29Chapter 17 of Title 39 of the Louisiana Revised Statutes of 1950, except with respect to time
30requirements, or, in order to encourage competition for the projects funded through this

1appropriation and to complete the projects in a timely manner, the Louisiana Stadium and
2Exposition District shall have the authority to select a general contractor through an RFP
3process whereby general contractors will bid general conditions and contractor's fee based
4on the direct construction budget.  The alternative time requirements shall be approved by
5the Commissioner of Administration before the awarding of any such contracts. Further,
6with respect to appropriations to the Louisiana Stadium and Exposition District for the TPC
7Louisiana, Planning and Construction project, the Louisiana Stadium and Exposition District
8shall be permitted to use alternative competitive procurement and delivery methods for the
9award of any contracts to be funded through such appropriation.  The Louisiana Stadium and
10Exposition District shall have the authority to directly appoint the design professional from
11a list of a minimum of three architectural firms or joint ventures with professional sports
12facility design experience acceptable to the Commissioner of Administration and shall be
13exempt from other state requirements for selection of designers.  The design professional fee
14shall be in accordance with state guidelines administered by the Office of Facility Planning
15and Control, Division of Administration.  Eligible expenses for Economic Development
16Award Program funds may include documented project expenses beginning on the date of
17LEDC Board approval of the project and may be reimbursed upon execution of the
18cooperative endeavor agreement for the project.  The new University Medical Center in New
19Orleans project in Orleans Parish shall be exempt from the state's requirements for selection
20of designers and the Commissioner of Administration shall have the authority to approve a
21design professional selection process.  The design professional fee shall be in accordance
22with state guidelines administered by the Office of Facility Planning and Control, Division
23of Administration.  The Division of Administration, Office of Facility Planning and Control,
24with approval of the Commissioner of Administration and the Joint Legislative Committee
25on the Budget, is authorized to use alternative delivery strategies in implementing hurricane
26damage repairs to Southern University at New Orleans, Hazardous Material Abatement
27Projects, the City Park Golf Complex Improvements project, the Health/Human Performance
28Education Complex, and the Patrick Taylor Hall Renovation and Expansion project.  In
29addition, with the approval of the Commissioner of Administration and the Joint Legislative
30Committee on the Budget, an alternative delivery strategy may be used in the

1implementation of the Louisiana Children's Museum, Early Learning Village project.  Due
2to the State's current investment in TPC Louisiana and the financial support it provides to
3the PGA TOUR event currently played at said facility, the funding of the City Park Golf
4Complex Improvements project described above is conditioned upon said PGA TOUR event
5not being played at New Orleans City Park Golf Complex without the prior agreement of the
6Commissioner of Administration and the Chairman of the Jefferson Parish Council.
7Notwithstanding the foregoing, the City Park Golf Complex may host any other golf
8tournament or event, including but not limited to any other PGA-affiliated or sponsored
9tournament or event.  For all projects administered by the Office of Facility Planning and
10Control and payable from proceeds of self-generated revenues, funds shall be remitted to the
11Office of Facility Planning and Control for deposit in the state treasury at such time as may
12be deemed necessary by the Office of Facility Planning and Control in order to cover the
13amount of contracts or other project expenses. The State Treasurer shall refund to the
14appropriate source any surplus self-generated funds, advanced insurance funds received by
15the Office of Facility Planning and Control as Interagency Transfer from Office of Risk
16Management associated with hurricane damage recovery, and interest earned on these funds,
17provided the Treasurer's Office is notified, when these funds are deposited in the state
18treasury, that the user agency or Office of Risk Management intends to request a refund of
19this interest.  Any revenue bonds appropriated in Section 1 of the Capital Outlay Act shall
20not be secured by the full faith and credit of the state. Notwithstanding anything in this Act
21or the Capital Outlay Act to the contrary or any other provision of law, contracts may be
22entered into for the Mississippi River Levee Raising, Arkansas to Old River project prior to
23receipt of funding, and the State is authorized to financially participate in obligations created
24by such contracts.  Notwithstanding anything in this Act or the Capital Outlay Act to the
25contrary or any other provision of law, contracts may be entered into for the Old McKinley
26High School Community Center on Thomas Delpit Drive in the City of Baton Rouge,
27Kitchen and Building Renovations, Repairs and Upgrades Including Elevator Repair Project
28prior to receipt of funding and prior to the execution of a cooperative endeavor agreement,
29and unless the Commissioner of Administration is advised by bond counsel to the state that
30such may violate federal tax law, the appropriation may be used to reimburse any

1expenditure made prior to the granting of a line of credit or the sale of bonds by the State
2Bond Commission.  Notwithstanding anything in this Act or the Capital Outlay Act to the
3contrary or any other provision of law, contracts may be entered into for the Tulane
4University Tulane River and Coastal Center Project prior to receipt of funding and prior to
5the execution of a cooperative endeavor agreement, and the project is exempted from all
6statutes relative to public bidding and state procurement and in lieu thereof shall be subject
7to federal government qualifications and regulations approved by the Economic
8Development Authority.  Notwithstanding anything in this Act or the Capital Outlay Act to
9the contrary or any other provision of law, contracts may be entered into for the Outpatient
10Clinics in Rapides Parish, Planning and Construction project for the Division of
11Administration prior to the execution of a cooperative endeavor agreement.  Notwithstanding
12any other provision of this Act or the Capital Outlay Act or any other provision of law to the
13contrary, funds appropriated for the Economic Development Award Program  project for the
14Office of Business Development are to be used solely for capital and infrastructure
15improvements subject to verification by the Division of Administration, Office of Facility
16Planning and Control.  Notwithstanding any other provision of this Act or the Capital Outlay
17Act or any other provision of law to the contrary,  all of the funds herein appropriated to the
18Department of Economic Development in connection with projects or programs for which
19the Department of Economic Development utilizes a cooperative endeavor agreement to
20further economic development as permitted under Article VII, Section 14 of the Louisiana
21Constitution, including the generation of tax revenues and creation of jobs, shall be
22considered as having been appropriated to the Department of Economic Development, may
23be used to reimburse any expenditure made prior to the granting of a line of credit and made
24prior to the execution of a cooperative endeavor agreement and shall be administered solely
25by the Department of Economic Development pursuant to, in compliance with, and on the
26terms contained in such cooperative endeavor agreements without compliance with any other
27law, including, but not limited to, the provisions of R.S. 39:101 through 128. Additionally,
28all expenditures of these appropriations may be exempted by the Commissioner of
29Administration, from all statutes relative to public bidding, contractual review and the
30provisions of R.S. 33:9029.2(D). Notwithstanding anything contained in this Act, the Capital

1Outlay Act, or any other provision of law to the contrary, the letting of a contract for
2construction of the "Louisiana Construction Center", funded wholly by the Louisiana
3Licensing Board for Contractors, shall be exempt from all statutes relative to public bidding
4and contractual review. Notwithstanding anything contained in this Act or the Capital Outlay
5Act or any other provision of law to the contrary, contracts may be entered into for the City
6of Gretna’s Lion’s Club Conversion to Senior Center project prior to receipt of funding and
7prior to execution of a cooperative endeavor agreement and the project is exempted from all
8statutes relative to public bidding and contractual review. Notwithstanding anything
9contained in this Act, the Capital Outlay Act, or any other provision of law to the contrary,
10the scope of the appropriation for the Department of Transportation and Development, LA
1122 Improvements (LA 16 to Diversion Canal), Planning and Construction (Livingston) is
12deemed to also include the overlay of LA 22 from Head of Island to Chinquapin Bridge. 
13Notwithstanding anything contained in this Act, the Capital Outlay Act, or any other
14provision of law to the contrary, the Department of Transportation and Development shall
15use $2,500,000 of general obligation bond funding appropriated for Department of
16Transportation and Development, Administration, Highway Program (Up to $4,000,000 for
17Secretary's Emergency Fund) in Act 25 of the 2014 Regular Session of the Legislature for
18the Louisiana Highway 92 Overlay, Preservation and Construction (Lafayette) project.
19Notwithstanding anything contained in this Act, the Capital Outlay Act, or any other
20provision of law to the contrary, $50,000 of the appropriation for Department of Natural
21Resources, Office of the Secretary, Atchafalaya Basin Protection and Enhancement (Federal
22Match and Local/Sponsor Match)(Assumption, Avoyelles, Iberia, Iberville, Pointe Coupee,
23St. Landry, St. Martin, St. Mary) will be used to fund House Concurrent Resolution No. 168
24of 2011.  Notwithstanding anything contained in this Act or the Capital Outlay Act to the
25contrary, any other provisions of law, or the provisions of R.S. 39:112(E)(2), the project for
26Eden House, New Facility, Acquisition, Planning and Construction, shall be exempt from
27all local match requirements.  Notwithstanding anything contained in this Act, the Capital
28Outlay Act, or any other Capital Outlay Act, the scope of the appropriation for the
29Department of Transportation and Development, Jimmie Davis Bridge Rehabilitation and

1to include the planning, design and construction of a new bridge.  Notwithstanding any
2provisions contained herein or any other law to the contrary, for projects with other means
3of financing provided to the administering agency by interagency transfer, the authority to
4draw these funds shall remain with the user agency.
5 Section 9.  Notwithstanding any provisions contained herein or any other law to the
6contrary, the provisions of Chapter 16 of Subtitle III of Title 39 of the Louisiana Revised
7Statutes of 1950 as amended, shall not apply to architectural and engineering contracts,
8administered by the office of facility planning and control, division of administration
9pursuant to this or any other capital outlay act.
10 Section 10.  All funds appropriated herein to the office of facility planning and
11control, division of administration, on behalf of non-state entities, and administered by
12cooperative endeavor agreements pursuant to this Act shall be expended within two (2) years
13from the date of the issuance of the bonds.  The office of facility planning and control,
14division of administration, agrees that it will notify the non-state entity of the date the bonds
15are issued within three (3) months from the issuance thereof.  The non-state entity
16understands and agrees that if the funds appropriated herein and administered under
17cooperative endeavor agreements pursuant to this Act are not totally expended within two
18(2) years from the issuance of the bonds, the office of facility planning and control, division
19of administration, can close the project and recommend that the legislature reallocate any
20unexpended proceeds to other projects.
21 Section 11.  Notwithstanding any provisions contained herein or law to the contrary,
22the proceeds of revenue bonds to be utilized to fund certain projects authorized in Section
231 hereof may, in accordance with Article VII, Section 9 of the Louisiana Constitution of
241974, be deposited in special accounts held outside the state treasury in accordance with the
25provisions of any bond resolution, indenture, reimbursement contract, or other bond or
26financing covenant which provides for the pledge of such funds in connection with the
27issuance of revenue bonds.  For all projects administered by the office of facility planning
28and control, division of administration, authorized in Section 1 hereof which are payable
29from the proceeds of revenue bonds, only the office of facility planning and control, division
30of administration, will be authorized to requisition funds from the special accounts described

1immediately above, at such time or times as may be deemed necessary by the office of
2facility planning and control, division of administration, in order to cover contract amounts
3or other project expenses. 
4 Section 12.  The governor shall have the power to veto any line-item in this Act.
5 Section 13.  Except as otherwise provided herein, no funds shall be expended on any
6highway projects on highways within the state highway system as established in R.S. 48:191
7under the jurisdiction of the Department of Transportation and Development unless and until
8such project is in the Highway Program, R.S. 48:228 through 232, approved by the Joint
9Legislative Committee on Transportation, Highways and Public Works.  Pursuant to R.S.
1049:214.6.2(B), no integrated coastal protection construction project shall be undertaken with
11funds included in this bill except those included in an annual plan finally approved by the
12legislature in accordance with the provisions of R.S. 49:214.5.3.  No funds appropriated to
13the Coastal Protection and Restoration Authority in this Act as a contribution for a project
14cost-share or otherwise, for the national economic development and national ecosystem
15restoration components of the Southwest Coastal Louisiana Study shall be used or provided
16for the expropriation of property or use of eminent domain, except where such funds are to
17be used to obtain property voluntarily offered for project purposes, where at least seventy-
18five percent of the owners have voluntarily offered the property, or where the record or
19apparent owners have voluntarily offered the property but do not have clear title.
20 Section 14.  The word "statewide" used in place of the specific parish designation for
21projects contained in this Act indicates that the project or program is applicable to all sixty-
22four parishes in the state.  The description of any project in this Act shall be deemed to
23include planning, design, master planning, studies, permits, surveys, testing, construction,
24land and/or building/improvement acquisition, reconstruction, renovation, repair, right of
25way and utilities, site and other improvements, miscellaneous/contingencies, lease hold
26improvements ultimately owned by the state or a political subdivision of the state, equipment
27and other acquisitions, and any other component of the project if such are included or
28indicated in the capital outlay request for such projects required by R. S. 39:101 subject to
29the provisions of Title 39 of the Louisiana Revised Statutes.  For new construction or
30renovation projects, equipment or other acquisitions, which can reasonably be considered

1necessary for the facility to be functional, may be deemed to be included in the project, even
2if such equipment or other acquisitions are not included or indicated in the project name or
3the capital outlay request.  When local or federal match is referenced in a project title, but
4only a portion of the state appropriation is granted a line of credit or otherwise funded, then
5the amount of local or federal match, required to be made available, may be prorated relative
6to the amount of state appropriation made available through lines of credit. 
7 Section 15.  The provisions, items, and projects contained in this Act are severable
8and if any provision, item, or project contained herein, or the application of any such
9provision, item, or project, is held invalid, such invalidity shall not affect other provisions,
10items, projects, or applications of the Act which can be given effect without the invalid
11provision, project, item, or application. 
12 Section 16.  Notwithstanding any other provisions of law to the contrary, the state
13shall not grant cash lines of credit, or authorize or issue general obligation bonds in a
14principal amount in excess of $1,140,750,000 for Fiscal Year 2017-2018. 
15 Section 17.  Notwithstanding any contrary provision of this Act or any contrary
16provision of law, no funds appropriated by this Act shall be released or provided to any
17recipient of an appropriation made in this Act if, when, and for as long as, the recipient fails
18or refuses to comply with the provisions of R.S. 24:513.  No recipient shall be considered
19to fail or refuse to comply with the provisions of R.S. 24:513 pursuant to this Section during
20any extension of time granted by the legislative auditor to the recipient to comply.  The
21legislative auditor is authorized to grant an extension of time to comply with the provisions
22of R.S. 24:513 for recipient entities of an appropriation contained in this Act.
23 Section 18.  This Act shall become effective upon signature by the governor or, if not
24signed by the governor, upon expiration of the time for bills to become law without signature
25by the governor, as provided in Article III, Section 18 of the Constitution of Louisiana.  If
26vetoed by the governor and subsequently approved by the legislature, this Act shall become
27effective on the day following such approval.
