HLS 17RS-19 REENGROSSED 2017 Regular Session HOUSE BILL NO. 200 BY REPRESENTATIVE FALCONER CIVIL SERVICE/MUNICIPAL: Provides relative to the municipal police civil service system for the city of Mandeville 1 AN ACT 2To amend and reenact Section 3 of Act No. 164 of the 1984 Regular Session of the 3 Legislature, relative to the city of Mandeville; to provide relative to the municipal 4 police civil service system; to provide relative to the personnel director responsible 5 for the administration of such system; to provide relative to the appointment of such 6 director; and to provide for related matters. 7 Notice of intention to introduce this Act has been published 8 as provided by Article III, Section 13 of the Constitution of 9 Louisiana. 10Be it enacted by the Legislature of Louisiana: 11 Section 1. Section 3 of Act No. 164 of the 1984 Regular Session of the Legislature 12is hereby amended and reenacted to read as follows: 13 * * * 14 Section 3. Personnel director; classification and compensation plan; rules 15 and rulemaking 16 A. Subject to the approval of the municipal governing authority, the board 17 may appoint and employ by competitive test a personnel director who shall be a 18 classified member of the civil service system and shall be responsible to the board 19 for the administration of the classified civil service system. The director shall 2 be subject to removal by the board but only for just cause and after public hearing 3 by the board. The human resources director for the classified civil service system 4 established by the home rule charter for the city of Mandeville shall be the personnel 5 director for the classified civil service system established by this Act. 6 B. The duties of the personnel director shall be as follows: 7 (1) To develop, to maintain, and to administer a classification plan to consist 8 of classes designated by standard titles and descriptions designed to provide for all 9 positions in the classified service. The adoption of such classification plan shall be 10 by rule of the board after public hearing. 11 (2) To develop and to administer a compensation plan for all positions in the 12 classified civil service. Such compensation plan shall be effective only upon 13 approval by the board after public hearing thereon and approval by the municipal 14 governing authority. 15 (3)(a) To develop such rules and regulations in accordance with this Section 16 as are necessary to carry out the provisions of this Act and to submit such proposed 17 rules and regulations to the board for review and public hearing and adoption, 18 amendment, or repeal. The board is hereby authorized to adopt, to amend, or to 19 repeal and to execute any such rule or part thereof. 20 (b) For the purposes of this Subsection, the personnel director shall be 21 responsible for the development of rules and regulations with respect to the 22 following: 23 (i) Policies and procedures for the administration of the classification plan 24 and for the compensation plan. 25 (ii) Policies and methods for administering competitive tests to determine the 26 merit and fitness of candidates. 27 (iii) Establishment and maintenance of employment eligibility lists and 28 procedures for certification of individuals from such eligibility lists for the filling of 29 vacancies. HLS 17RS-19 REENGROSSED HB NO. 200 1 (iv) Procedures for layoff, suspension, demotion, and dismissal of employees 2 which shall provide for public hearing before the board in cases of suspension, 3 demotion, or dismissal of permanent employees. 4 (v) Hours of work, attendance, and sick and vacation leave regulations. 5 (vi) Prohibition against political activities of employees and assessment for 6 political purposes. 7 (vii) Other policies, procedures, and practices as necessary to administer the 8 classified civil service system. 9 C. In lieu of appointing a personnel director, as provided in this Section, the 10 board may assume all the powers and duties of the personnel director as provided in 11 this Section. 12 * * * 13 Section 2. This Act shall take effect and become operative on the first day of January 14following an election at which a majority of the voters of the city of Mandeville approve an 15amendment of the city's home rule charter to provide that the human resources director of 16the classified civil service system established by the charter shall be the personnel director 17of the classified civil service system established by Act No. 164 of the 1984 Regular Session 18of the Legislature. Present law (Act No. 164 of the 1984 Regular Session of the Legislature) creates and provides for the Municipal Police Employees Civil Service in the city of Mandeville. Provides that classified civil service shall embrace all positions of employment and all officers and employees. Present law creates and provides for a Municipal Police Employees Civil Service Board of the city of Mandeville for the purpose of administering the classified civil service system created pursuant to present law. HLS 17RS-19 REENGROSSED HB NO. 200 Present law authorizes the board, subject to the approval of the municipal governing authority, to appoint and employ a personnel director who is a member of the classified civil service system and is responsible to the board for the administration of the system. Provides relative to the qualifications and compensation of the personnel director. Further authorizes the board, in lieu of appointing a personnel director, to assume all the powers and duties of the personnel director. Proposed law removes present law and instead provides that the human resources director for the classified civil service system established by the home rule charter for the city of Mandeville shall be the personnel director for the classified civil service system established by present law. Effective on the first day of Jan. following an election at which a majority of the voters of the city of Mandeville approve an amendment to the city's home rule charter to provide that the human resources director of the classified civil service system established by the charter shall be the personnel director of the classified civil service system established by present law.
