LAW ENFORCEMENT:  Expands requirements within driver education and prelicensing
training courses
1	AN ACT
2To enact R.S. 32:402.1(B) and (C) and to repeal R.S. 32:402.1(A)(3)(c), relative to driver
3 education and prelicensing training courses; to increase requirements within driver
4 education and prelicensing courses; to provide for the establishment of a curriculum
5 relative to the economic effects of littering; to require the course curriculum includes
6 a section on how to respond to a traffic stop; to provide for the establishment of
7 rules, regulations, and requirements for the course; and to provide for related matters.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 32:402.1(B) and (C) are hereby enacted to read as follows:
10 ยง402.1.  Driver education; required

12	B.  The Department of Public Safety and Corrections, public safety services,
13 shall establish a portion of the "driver education course" and "prelicensing training
14 course" relative to the economic effects of littering in conjunction with Keep
15 Louisiana Beautiful, Inc.
16	C.  The Department of Public Safety and Corrections, public safety services,
17 shall establish and implement a portion of the "driver education course" and
18 "prelicensing training course" relative to managing a routine traffic stop. The
19 department shall establish rules and regulations to administer and define the
20 requirements within the course. The curriculum shall be developed considering the

1 actions of officers, the drivers and occupants, the number of occupants, the time and
2 reason for the stop, the location of the stop, and any other circumstance surrounding
3 the stop. At a minimum, the course shall include the following:
4	(a) Instruction concerning law enforcement procedures for traffic stops.
5	(b) Instruction on the importance of officers, drivers, and passengers
6 maintaining integrity and respect during traffic stops.
7	(c) Demonstrations of appropriate interactions with law enforcement.
8	(d) Demonstrations of the proper actions to be taken during traffic stops.

10 Section 2. R.S. 32:402.1(A)(3)(c) is hereby repealed in its entirety.

Abstract:  Establishes and implements guidelines for managing routine traffic stops within
driver education courses.
Present law requires the Dept. of Public Safety and Corrections, public safety services,
establish the portion of the driver education or prelicensing training course relative to the
economic effects of littering.
Proposed law modifies present law by redesignating the provision within driver education
or prelicensing training course relative to the economic effects of littering.
Proposed law requires the Dept. of Public Safety and Corrections, public safety services,
establish and implement a curriculum within the driver education and prelicensing training
courses relative to managing a routine traffic stop.
Proposed law requires the department establish rules and regulations to administer and
define the requirements within the course.
Proposed law requires that the curriculum be developed considering the actions of officers,
the drivers and occupants, the number of occupants, the time and reason for the stop, the
location of the stop, and any other circumstance surrounding the stop.
