MEDICAID: Provides relative to pharmacy reimbursement by managed care organizations 1 AN ACT 2To amend and reenact R.S. 46:460.36(D), relative to Medicaid managed care pharmacy 3 reimbursements; to provide for the base of reimbursement for prescription drugs; and 4 to provide for related matters. 5Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 46:460.36(D) is hereby amended and reenacted to read as follows: 7 ยง460.36. Pharmacy reimbursement by managed care organizations 8 * * * 9 D. After June 15, 2016, July 1, 2017, no managed care organization shall pay 10 a local pharmacy a per-prescription reimbursement at a rate less than the legacy 11 Medicaid rate. unless its contract with the department provides for a reimbursement 12 dispute process as described in Subsection C of this Section. 13 * * * 14 Section 2. This Act shall become effective upon signature by the governor or, if not 15signed by the governor, upon expiration of the time for bills to become law without signature 16by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 17vetoed by the governor and subsequently approved by the legislature, this Act shall become 18effective on the day following such approval. Present law prohibits a managed care organization from paying a local pharmacy a per-prescription reimbursement at a rate less than the legacy Medicaid rate unless its contract with the La. Dept. of Health provides for a reimbursement dispute process. Proposed law removes the requirement for a reimbursement dispute process. Effective upon signature of governor or lapse of time for gubernatorial action.
