HEALTH CARE: Amends the Polysomnographic Practice Act 1 AN ACT 2To amend and reenact R.S. 37:2870(A)(1) and to repeal R.S. 37:2862(11), 2865(A)(3), and 3 2866, relative to the practice of polysomnography; to authorize individuals enrolled 4 in a certified education program to practice polysomnography; to repeal 5 requirements for polysomnographic technicians; to require rulemaking by the 6 Louisiana State Board of Medical Examiners; and to provide for related matters. 7Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 37:2870(A)(1) is hereby amended and reenacted to read as follows: 9 ยง2870. Prohibitions 10 A.(1) No individual shall engage or attempt to engage in the practice of 11 polysomnography or perform or attempt to perform polysomnograms, unless he 12 holds a license issued the individual is one of the following: 13 (a) Licensed by the Louisiana State Board of Medical Examiners in 14 accordance with the provisions of this Chapter. 15 (b) Enrolled in one of the following: 16 (i) A program accredited by the Commission on Accreditation of Allied 17 Health Education Programs. 18 (ii) A sleep technologist program accredited by the American Board of Sleep 19 Medicine. No later than December 31, 2017, the Louisiana State Board of Medical 7Examiners shall promulgate a notice of intent, in accordance with the Administrative 8Procedure Act, for all administrative rules and amendments necessary to bring their policies 9and procedures into conformance with the provisions of this Act. Present law prohibits an individual from engaging or attempting to engage in the practice of polysomnography or performing or attempting to perform polysomnograms, unless the individual is licensed by the La. State Bd. of Medical Examiners (LSBME). Proposed law retains present law but authorizes the practice of polysomnography if the individual is enrolled in one of the following: (1)A program accredited by the Commission on Accreditation of Allied Health Education Programs (CAAHEP). (2)A sleep technologist program accredited by the American Board of Sleep Medicine. (3)A sleep technologist program approved by the Bd. of Registered Polysomnographic Technologists. Present law defines "polysomnographic technician" or "permit technician" as an allied health professional who holds a permit issued by the LSBME to practice polysomnography under the direct supervision of the physician or a qualified allied health professional licensed by the LSBME whose scope of practice includes polysomnography. Proposed law repeals present law. Present law requires an applicant for a polysomnographic technologist license to demonstrate that the applicant has graduated from a CAAHEP accredited program and has passed an examination that is administered as a component of a certification program that is accredited by a national accrediting organization approved by the LSBME.
